The Oklahoma House and Senate leaders and Oklahoma Attorney General Gentner Drummond ( R ) both expressed concern about the state-level criminality of being an illegal immigrant in Oklahoma.
Less than 24 hours after the U.S. Supreme Court granted the State of Texas the authority to pass Senate Bill 4, position lawmakers said it was time for Oklahoma to pass its own version and start retaliating against illegal immigrants in the state of Oklahoma.
” When the Supreme Court indicated that Texas would more than likely prevail in this fight, that’s when I turned my attention to the Speaker]of the Oklahoma House ] and President Pro Tem]of the Oklahoma Senate ]”, Drummond told FOX23.
Drummond claimed that the high court’s decision to pass the law in its own immigration measures was justified because it was put on hold once more by a Federal appeals court while the legality of it was being debated.
” The Biden Administration has just failed to secure our frontiers, and Oklahoma is being invaded”, Drummond said.
FOX23 questioned Drummond about whether the law may require that unintentional people get questioned about their status and if they would be asked about their position. He claimed that reputation would only be requested if an offense had been committed or a case was being looked into. He claimed that a mother who illegally crossed the U.S. border with her child while searching for a better life should not be subject to the new rules, but that his office has spoken with numerous members of the Chinese and Mexican group cartels who were present at crime scenes who were still there improperly. Best now, he said, the Federal government merely is focused on great people and legal kingpins.
When we enter an illegitimate grow facility, he said, “our frustration is that we have probable cause to assault kingpins, those who have committed crimes that we can pin to them.” However, there are a lot of staff who are also people of a gang, who are not doing anything that against the law when they are present, but they are there improperly.
FOX23 inquired if a less serious non-drug offense like driving could result in somebody being detained for being an illegal immigrant when a straightforward ticket is being written and the individual then returns home and pays a good.
” If you are speeding, you could very well be questioned about your position as part of the inquiries you are asked during a transportation stop,” said Drummond.
But, Tulsa County Sheriff Vic Regalado, who says the Southern Border is a disaster, said if the rules is rushed, he sees a whole host of responsibilities for county and city law enforcement agencies.
” I’m never for thigh- bully responses, and I do blame our state for the condition in which we are in”, Regalado told FOX23. The Biden Administration has ultimately failed the American citizens, and I find it unnerving that local law enforcement has to deal with such problems.
Regalado, who is Latino himself, expressed concern that the law’s poor writing could lead to racial stereotyping and targeted individuals based solely on the skin color. He specifically recalls a time when a regional judge in his condition attempted to stop illegal immigration while he was traveling with his father in Arizona.
” I can vividly recollect being with my parents in Phoenix, Arizona during Joe Arpaio being sheriff”, he said. ” and my father being pulled over, and being promptly questioned if he was from the country he is from, and he fought in Vietnam, fought for his country, and all those stuff.”
Regalado said the law may be certain as to its purpose and application. Any ambiguous language will increase issues and potential claims for regions.
We wo n’t get called if we create an environment where our immigrant communities wo n’t call us because of that particular mistrust, concern about being deported, or legal status, he said. What you will see is crime rise in those areas because they do n’t trust us to come and help them when they need us, the article says.
He added that he had questions about how the rank check may be verified by his deputies. He is unsure whether a linguistic response will satisfy or whether sufficient evidence will be used.
What if you were pulled over but forgot your wallet at home because you are an American citizen with colored body? he said. What if you are not a citizen but you are here legally and do n’t bring your documents with you?
Regalado argued that state lawmakers should give state and local law enforcement more money to deal with the potential for a flood of illegal immigrants entering their jails.
If we do this, he said,” We wo n’t receive funding from the Biden Administration to house these people.” ” They’ve been cutting ICE’s budget for years because they do n’t see this as an important issue. They allow it to find this bad.
Regalado remained critical of a FOX23 problem from October. The Biden Administration, when it first took office, ordered jails like his to allow illegal immigrants to bond if they have n’t committed a crime deemed serious enough for them to be kept behind bars. Even if an illegal immigrant is arrested and placed in the Tulsa County Jail, they can still be held there.  ,
” We have to know that even if we do assault them, with the way things are right now, they’re only going to get out, and they’re not going to present up to court because they’re going to run away and hide”, Regalado said.
State legislators should consider whether they can refuse a connection to a person and what their potential looks like, according to Drummond and Regalado. According to Regalado, a person’s arrest and a prison sentence will eventually result in their returning to the group after with little to no alter in their immigration status. In Texas, the state would pay for someone’s deportation to Mexico if they were found guilty of entering the express improperly.  ,
Governor Kevin Stitt’s business stated that he would observe the act and look into the language if it was even proposed, and that he is willing to invest more resources to help the State of Texas fight more unlawful immigrants entering Mexico.
Some are eager to see what is being proposed because regulations may be filed as early as the following year.
A bill was introduced to criminalize being an undocumented immigrant in Oklahoma during this legislative session and has since passed the council. However, it died last week in the full House because it did n’t get a vote before a critical legislative deadline.
” It’s disappointing that House Bill 4090 failed to advance”, State Representative David Hardin ( R- Stilwell ), the bill’s author, said. ” Under Joe Biden’s leadership, the border crisis has reached extraordinary rates, forcing states to work on their own. This bill would have made a major contribution to addressing our state’s pressing issue of illegal immigration. Otherwise, we continue to be ineffective with regulating the illegal entry of people into Oklahoma.
It’s not known whether congressional leadership will resurrect HB 4090 to try to accomplish their goal this program or introduce a new law.
