
A man found illegally in Iowa after receiving a due imprisonment or access denial may be charged under Senate File 2340 as a state Course C or Class D felony.
The bill did accept Iowa judges to get someone to be deported or jailed before they have an opportunity to pursue charitable protection, and accept state law enforcement to arrest and deport illegal immigrants.
The act has received strong criticism from the American Civil Liberties Union of Iowa. Mark Stringer, ACLU of Iowa Executive Director, issued the following speech:
” The Iowa Legislature has passed one of the most extraordinary, discriminatory, and illegal anti- immigrant bills in the country, which is based on a Texas rules that the courts have now blocked. If Gov. This bill, signed by Kim Reynolds, will allow authorities to detain people based on their federal immigration status and accept Iowa judges to get someone deported or imprisoned before they have the opportunity to pursue charitable protection that they are entitled to, as it will go into effect on July 1.
The state judges and law enforcement in Iowa who are tasked with carrying out this outrageous legislation are not educated in immigration law and have no proper authority to carry out it. This regulation encourages and makes racial profiling and stereotyping easier. It undermines—not promotes—public safety and the rule of law. It will use already limited resources for law enforcement and state courts. This law, if passed, will endanger Iowans, both citizens and noncitizens, and will devastate both families and communities.
The bill’s passage has sparked a lot of discussion about how the Iowan government might affect both citizens and noncitizens ‘ lives, as well as their own.
