A contentious new immigration laws in Texas was approved by the Supreme Court on March 19th.
However, a few hours after, the law, which would help local and state law enforcement to deport and arrest people who were in the state illegally, was blocked. Once.  ,
A Northeastern University immigration law specialist says it’s hardly surprising that Senate Bill 4 or SB 4 has been constantly blocked, but rather that the law has been recently allowed.
The only surprising aspect of this event so far is the fact that it initially appeared to be going into effect, according to Rachel Rosenbloom, a teacher at Northeastern University School of Law. ” That was amazing because it is, in the existing situation law, a very, very obvious- cut problem”.
” States just ca n’t do this”, Rosenbloom continued. ” They ca n’t go out on their own and usurp the federal government’s power over immigration”.
The Texas legislature passed SB 4 last month, making the illegal migration of people from other states a state offense. It is already a federal offense to enter the country through a port of entry. Additionally, the law establishes a state criminal for unlawful reentry.
According to the law, Texas’s law enforcement has the authority to detain, confine, and prosecute people who are accused of rehabilitation and unlawful entry. Additionally, it gives Texas courts the option of ordering immigrants to go back to Mexico as a substitute for pursuing their criminal prosecution.

The Justice Department has said SB 4 problems with national law and the Constitution, as immigration protection has long been a national responsibility. The department also asserted that the measure hurts relations with Mexico, which has labeled SB 4 as “anti-immigrant” and pledged to dismiss Texas-returned immigrants.
Rosenbloom says that existing event law supports the federal government’s place.  ,
” This is a very open- and- shut situation”, Rosenbloom says. It’s foolish to make estimates, but there’s no means a position could began enforcing immigration rules if you abide by the current case law.
Rosenbloom also points out that there are currently federal offenses involving illegal entry and reentry into the country.  ,
” The federal government has power over who can come in, what their reputation is, anything to do with the frontier and with multiculturalism, with imprisonment, with anyone associated with immigration”, Rosenbloom says. ” When there’s national laws and state laws and they fight, the federal law wins”.
Also, the Supreme Court has reinforced federal control of immigration rules in judgement against Arizona’s” Present me your papers” legislation in 2012, Rosenbloom says.
To be sure, but, Rosenbloom notes that the recent Supreme Court has upended precedence before, for instance, in ruling against Roe v. Wade in 2022.
” We’ll see what happens”, Rosenbloom says. ” You never know in this age we’re living through” . ,
She says that allowing SB 4 had, yet, unleash” full chaos”.
According to Rosenbloom,” If Texas is allowed to do this, many other states may try to follow in its midst, and the outcome may be total chaos.”  ,
Rosenbloom also refuted Texas ‘ contention that the border is “in a state of crisis that would support an extraordinary measure such as SB 4.”
According to Rosenbloom,” there is a bit of language about the so-called border crisis” right now. Well, a lot of people are crossing the border these days. However, these are not extraordinary quantities. Numerous migrants have already been greeted in the United States, and many of them have since become important people of our societies.
She continues, adding that “many, some countries in the world are hosting much more immigrants than we are equal to their people.”
” The real issue at the frontier is the fact that person’s access to established border crossing points has been blocked”, Rosenbloom continues. A set of guidelines designed to prevent citizens from being able to access the system is what we’ve seen over the past few years, starting with the Trump presidency. That is what is preventing asylum applicants from attempting to enter much more unsafe locations. That’s the conflict at the border best now that we are facing”.
