As the trial  enters its next quarter, jurors in the case of an Arizona farmer who is accused of fatally shooting a migratory on his home will be able to explore the ranch near the border with Mexico as early as this month.
Judge Thomas Fink of the Santa Cruz County Superior Court stated last week that he would permit the attend, but has not specified a day or occasion. The news media requested on Monday to follow jurors at George Alan Kelly’s house, which they denied.
The prosecutor has stated that the visit will aid judges in the” honest determination of the claims in this case,” but he continued to press on Monday that his restrictions on questioning and photographing jurors would make it too difficult for the media to travel.
For trips are fairly remarkable.
After dark, national judges in the test of a U.S. Border Patrol agent accused of fatally shooting a teenager across the Mexican border in the Nogales, Arizona, place were taken to the image of the shooting to observe situations as they may have been at the moment. When jurors failed to reach a verdict on a voluntary manslaughter charge, former agent Lonnie Schwartz was found innocent in the killing of 16-year-old Jose Antonio Elena Rodriguez.
Wanda, Kelly’s wife, testified that she saw two men carrying rifles and backpacks pass their ranch house on the day of the shooting in the trial against him.
A group of migrant ranches on the day’s ranch heard from a Honduran man who witnessed Gabriel Cuen-Buitimea, 48, fall to the ground after being struck. Cuen- Buitimea’s bullet was never recovered.
Kelly was arrested and charged last year in the Jan. 30, 2023, fatal shooting of Cuen- Buitimea, who lived in Nogales, Mexico, just south of the border.
Prosecutors have said Kelly, who was also armed with a handgun,  , recklessly fired an AK- 47 rifle , toward the migrants, who were about 100 yards (90 meters ) away from him on his nearly 170- acre (69- hectare ) cattle ranch. Kelly and his defense team reject that narrative.
Since the trial started on March 22 and the proceedings have been going on four days a week. It is anticipated to come to an end on April 19.
Border security is a key issue in this year’s presidential contest, with Republican Donald Trump and Democratic President Joe Biden making , dueling visits , to the Texas- Mexico border in late February.
