ATF Final Rule Redefines Word ‘Sale’ So that ‘Bartering’ for a Neighbor’s Gun Requires a NICS Check

In order to use the National Instant Criminal Background Check System ( NICS), private sellers who receive services or barter in exchange for a gun are required to redefine the word” sale.”

Breitbart News&nbsp, reported&nbsp, the ATF’s statement of the proposed law on August 31, 2023. The rule expands the situations where an unlicensed seller, i .e., a private citizen, must use the NICS to sell or transfer a gun by redefined what it means to be “engaged in the business of selling guns.”

Private retailers are defined as those who may pass through NICS to sell/transfer weapons because a large portion of the principle focuses on guns being sold for “profit.”

However, pages 26- 27 of the concept equates “pecuniary get” with “profit”, opening the door for the ATF to redefine the word” price” so as to require a NICS test when a private vendor is “bartering” over a gun.

The user can see clearly that the ATF is defining the terms in the last paragraph of website 26 before reading into the first paragraph of page 27 to understand that bartering or providing or receiving services in exchange for firearms with the predominate intention to gain financial gain yet where no money is exchanged.

Alan Gottlieb, the founder and executive vice president of the Second Amendment Foundation, made a comment regarding the ATF law, saying,” This is a continuation of the Trump battle on guns. Another try to circumvent Congress to pass new laws without the consent of the Congress is made.
