The last regulations aim to make sure that all students receive appropriate support when they experience sexual discrimination, according to the rules. They also make it clear that all parties involved will be treated fairly when they are pursuing complaints of gender discrimination.
The rules do even more harm, however, such as by undoing Trump-era expected approach safeguards for those accused of sexual wrongdoing, which could include simply using appropriate pronouns. By encouraging schools to censor students and teachers with their traditional views on sex and marriage in order to avoid losing federal funding, they also violate parents ‘ rights and pose a threat to academic freedom of speech.
In the rules, the Biden administration explicitly admits it relied on the Supreme Court’s Bostock v. Clayton County determination to tell its rulemaking.
