In a New York recording studio on Friday, Sean” Diddy” Combs filed a lawsuit that alleges he and two other defendants sexually assaulted a 17-year-old girl in the name of “false and hideous” and filed it too late in the eyes of the law.
The 54-year-old hip-hop tycoon and his legal team have responded in recent months with this legitimate move following a number of similar lawsuits and a subsequent judicial sex-trafficking investigation.
According to the filing, which names Combs-owned firms as defendants,” Mr. Combs and his companies absolutely deny Plaintiff’s decades-old story against them, which has already caused unimaginable harm to their reputations and firm standing before any evidence has been presented.” Despite her alleged exhausted state,” Plaintiff suddenly recalls another lurid information,” despite which time or occasion the alleged incident occurred.
The girl, who currently resides in Canada and whose name was not made public in the courtroom processing, filed the lawsuit in December and changed it in March. She claimed that Harve Pierre, the then chairman of Combs ‘ Bad Boy Entertainment record label, flew her to New York on a private plane and took her there until she was unable to consent to having sex when she was in the eleventh grade in a Detroit district in 2003. There, she was given drugs and alcohol until she was unable to have sex. Then, the lawsuit said, Pierre, Combs and a man she did n’t know took turns raping her.
She claimed that the woman’s photos were taken on the day of the lawsuit, which included images of her on Combs ‘ shoulder.
The defense’s complaint requests that the case be “dismissed now, with prejudice” ( meaning it cannot be refiled )” to protect the Combs Defendants from further reputational harm and before more party and judicial resources are wasted”
One of the defendant’s attorneys, Michael J. Willemin, said in a statement in response to the submitting:” At this point, no one should consider everything’ diddy’ or his lawyers say severely. Combs’s latest move to discredit Ms. Doe’s alleged gang rape and sexual abuse is just a hungry ploy to hide the truth behind yesterday’s motion. It wo n’t work”.
The arguments are made in a preliminary stage of the complaint rather than based on the case’s information.
Some of the lawsuits brought against Combs involve decades-old allegations, including those involving the more than 3,700 claims made under the Adult Survivors Act, which briefly suspended legitimate deadlines for sexual assault victims in order to give them one more reason to file legal action after abuse that occurred years or even decades ago.
The match Combs filed on Friday was filed under a different legislation, the Victims of Gender- Motivated Violence Protection Law in New York City, but those deadlines have since expired. After the statute of limitations has expired, prosecutors may even report civil lawsuits against the city for sexual assault says.
However, Combs ‘ action contends that the lawsuit was filed too late because the state law requires that the lawsuit get filed by August 2021, making it necessary to do so.
” New York state laws trumps New York City legislation, without different,’ the filing says.
Some of these issues were addressed in the amended edition of the complaint filed in March, but Combs ‘ prosecutors contend that it was insufficient.
If the petition proceeds following this problem, the judge has decided that the woman must file a name-sharing agreement.
People who claim to have been sexually abused are generally not identified by The Associated Press until after their allegations are publicly revealed, as some of Combs ‘ prosecutors have done.
Friday’s defense filing even criticizes the suit for including” a outlined, officially unimportant’ trigger warning’ calculated to focus attention on its lurid and depraved allegations.”
The singer Cassie, his ex-girlfriend, and his former girlfriend, filed a lawsuit in November, which contained allegations of beatings, rape, and other forms of abuse between 2005 and 2018. The complaint was settled the day after it was filed by the same attorneys who filed the lawsuit that was being challenged Friday. Before the settlement, Combs ‘ attorney, who denied the allegations, came forward.
In the months that followed, Combs was the target of more lawsuits. In a sex-trafficking investigation, Homeland Security Investigations issued search warrants for his homes in Los Angeles and Miami on March 25. It was a flagrant use of military-level force, according to his attorney. ” The investigation is continuing. Combs has not been charged.
Joi Dickerson, a 19-year-old college student, claimed she was a victim of sexual assault when Combs drugged and sexually assaulted her. Combs filed a motion to dismiss her case last month.
