Sens. Bill Hagerty (R-TN) and Rep. Byron Donalds (R-FL ) are sponsoring legislation that streamlines a federal system and makes it simpler for illegal aliens to arrest.
The” Reshape Alternatives to Detention ( ATD ) Act” would prevent Biden’s Department of Homeland Security ( DHS) from transforming the enforcement program, meant to monitor migrants in the U. S. who are in immigration court proceedings, into a taxpayer- funded social services program.
To apprehend migrants arriving at the southern border, DHS would need to use all the available detention area.

The legislation mandates that DHS place migrants with GPS tracking in the ATD program after all applicable detention space is used, as opposed to the current arrangement where most migrants are permitted to reside within the United States without any monitoring.
DHS had monitor those workers for the duration of their immigration judge proceedings using GPS.
The Biden Administration “permitted a tidal wave of unlawful foreigners to cross our southern border, which has led to an extraordinary national security crisis and humanitarian crisis,” Hagerty said in a statement.
However, Biden’s DHS is refusing to impose the laws already in place and making obvious efforts to end confinement and allow illegal immigrants to travel freely throughout the country by abusing ATD, rather than using all available resources to address the issue. Currently, fewer than 195, 000 migrants are enrolled in the ATD program — making up a fraction of the more than 6.2 million migrants who are in Immigration and Customs Enforcement’s ( ICE ) “non- detained docket”, which allows them to live freely in the U. S. while in immigration court proceedings.
By October, specialists project that those migrants living in the U. S. on ICE’s no- imprisoned case will reach more than 8 million, an unprecedented level. For assessment, in 2019, only three million refugees were on ICE’s no- detained docket.
A potential administration with a emphasis on removals would be able to more quickly locate, hold, and deport illegal aliens who are found to include irrelevant asylum claims and have no basis to stay in the United States. Due to GPS tracking, millions of migrants on ICE’s non-detained court would be able to do so.
While migrants seeking resettlement in a sanctuary jurisdiction would not be eligible to enroll in ATD, the bill requires DHS to notify local law enforcement of those migrants who flee from ATD.  , Migrants being GPS- monitored would have to check in with DHS or face expedited deportation.

In addition, the legislation would terminate the Biden administration ‘s , Case Management Pilot Program ( CMPP ) and the Young Adult Case Management Program (YACMP ) which offer taxpayer- funded social services to migrants in immigration court proceedings.
Instead, funding for CMPP and YACMP would be moved to increase the number of detention places for migrants crossing the border. Those immigrants who were enrolled in both programs would be placed in DHS detention on their own.
The Reshape ATD Act is being pushed by the National Immigration Center for Enforcement ( NICE), led by RJ Hauman. Hauman wrote to lawmakers:
The Biden Administration’s abuse ( and watering down ) of ATD would be stopped by the Reshape ATD Act, in part by requiring DHS to use every available detention bed before turning to ATD, and making sure that all illegal aliens on the non-detained docket ( currently 190k ) are monitored GPS throughout their immigration proceedings, including appeals, for the duration of their immigration proceedings.
The need for such a policy was highlighted in former Acting ICE Director Tom Homan’s op-ed in Breitbart News last year:
So, in the face of this Biden- induced reality, what can be done? First, Title 8 should be immediately used to expel people who are found to be not permitted to enter the country. Second, ICE should detain and deport all aliens who have received final removal orders as well as those who have been delayed removal. Third, for those not in ICE detention, including the millions on the non- detained docket, we should at least be tracking them with GPS so they do n’t abscond. The Intensive Supervision Appearance Program ( ISAP ), an ICE program that provides this, uses GPS capabilities through monitoring tools like ankle bracelets and wrist trackers as well as GPS-enabled apps. ]Emphasis added]
ICE should impose penalties on those who do n’t appear in court and refuse to comply with their release’s terms, but ISAP has a 98 percent success rate when migrants are kept connected to technology throughout their legal proceedings. If it works, let’s use it.

On Biden’s watch, DHS has been deporting , just one illegal alien from the U. S. interior for every roughly 70 migrants arriving at the border. Meanwhile, DHS data suggests that migrants arriving at the border have a 70 to 90 percent chance of being released into the U. S. interior.
