Rep. Kelly Armstrong (R-ND), a member of the House Judiciary Committee, said during an appearance on Breitbart News on Saturday that Republicans are “absolutely” advocating to issue President Joe Biden’s use of executive privilege to obstruct the launch of the audio recording of his meeting with Special Counsel Robert Hur.
Armstrong explained that the whole House might consider impeaching Attorney General Merrick Garland, but the question is: Does Congress run out of time before the election for president? When Biden was asked if there was a constitutional challenge to his use of executive privilege to conceal the sound recording, the senator responded that there is “actual law that states that when you release information to the media, executive opportunity is waived.”
But, I believe you and I both concur that this is not a legitimate professional luxury state. But, regardless of that, I do n’t think that question is really the answerable question. The question is: when he waived it, when he released it to the internet, he waived the opportunity. But I think, no matter what happens on the time clock — I mean, you and I know that…the court system does n’t move as fast…it’s only Democrats that think that the court system should care about what day the election is, but I think it’s really important, no matter what happens — that we maintain the House and move forward on this”, he said, explaining that this is “hugely impactful and important…not only for this election”.

In other words, Armstrong thinks it may continue to push the issue even if Congress is unable to receive the sound before the election.
When asked if there is going to be a problem in court, Armstrong said,” I know for a point that my chair, Jim Jordan, and his associate, Kelly Armstrong, are going to be advocating positively that we…pursue this as violently in court — if that’s where we have to get — as possible”.
