On Tuesday, President Joe Biden issued an executive order authorizing about 2,500 migrant encounters at the US-Mexico border before the Department of Homeland Security ( DHS) can regulate the border, but only between ports of entry.
Details of the DHS’s decision reveal that Biden took inspiration from a failed Senate immigration agreement, which allowed hundreds of regular migrant encounters at the country’s southwestern boundary before DHS was able to regulate portions of the border.
Most importantly, the purchase directs DHS Secretary Alejandro Mayorkas to simply enclose these areas of the frontier after 2,500 migrants have been encountered in the span of seven days. This is the equal of about 17 500 migrants crossing the border each year, or about a million people arrive annually.

Previous DHS Secretary Jeh Johnson, who served under former President Barack Obama, said in 2019 that regular immigrant contacts hitting or exceeding 1, 000 are considered problems- level.
Workers crossing between ports of entry are unable to seek asylum according to border restrictions caused by migrant encounters exceeding 2,500 for seven days on average. When average daily encounters have dropped below 1,500 over the past week, Mayorkas can begin allowing migrants to cross between ports of entry to seek asylum once more.
In reality, Mayorkas is grant asylum applications to people who cross between ports of entry after 14 days of restrictions.

More than 370, 000 UACs were transferred from the boundary to the Office of Refugee Resettlement for resettlement across American populations from Fiscal Year 2021 through Fiscal Year 2023.
