The Nevada Republican Party, former president Donald Trump’s plan, and the Republican National Committee sued Nevada for counting mail-in votes that are received the day after an vote and do not have postmarks.
The RNC stated in a media release on Monday that mail-in votes must be postmarked “on or before Election Day” in accordance with state law. Michael Whatley, the president of the RNC, explained that” counting votes” after the day of the vote” creates a concerning and potentially fraudulent effect” on the country’s elections.
The RNC explained that this helps prevent “ballots received after the Election from being included” in the outcomes.
Whatley wrote in a statement that counting ballots received after Election Day without a stamp has a concerning and possibly fraudulent effects on Nevada’s votes. ” We are filing this petition to make sure Nevada legislation is upheld and that the Silver State’s election integrity is promoted.”
In violation of the law, Nevada election officials constantly count non-postmarked mail vote received after Election Day, according to the RNC’s press release.

In the complaint filed past month against Nevada Secretary of State Francisco, Cari- Ann Burgess, the Washoe County Registrar of Voters, Jan Galassini, the Washoe County Clerk, Lorena Portillo, the Clark County Registrar of Voters, and Lynn Marie Goya, the Clark County Clerk, the RNC, Trump campaign and the Nevada GOP stated that the purpose of the lawsuit was to find” to maintain one important component of Nevada’s post- election day counting of ballots”.
Previous Nevada Gov. Steve Sisolak ( D) signed , Assembly Bill ( AB) 321 law into effect in June 2021 which made mail- in voting practices in the state a permanent fixture.
According to the Daily Indy, mail-in ballots that are delivered within four days of the vote are included in the results under AB 321.
” We are committed to ensuring the dignity of Nevada’s elections and inspiring vote confidence”, Michael McDonald, the president of the Nevada Republican Party, said in the media release. ” Given that ballots without postmarks may be counted improperly undermines both.” We will continue to fight for good votes where even legitimate votes are cast and the system is secure for all Nevadans.
Similar complaints have also been filed in state like Mississippi and North Dakota regarding the counting of mail-in ballots received after the election time.
