Sen. Joe Manchin ( W. Va. ), who left the Democratic Party last week to become an independent, is leading 45 of his Senate Republican colleagues in a resolution to overturn a Biden administration rule regarding the care of unaccompanied migrant children.
” Our southern border is in turmoil, and the effects are absolutely devastating on people.” I’ve constantly urged President Biden to use his administrative rights to stop it and stop the abuse that illegal immigration engenders. Otherwise, the Administration permits regulations like this one that could endanger the safety of immigrant children and place them in the arms of unvetted partners,” Manchin said in a statement.
Manchin claims that the proposed rule from the Department of Health and Human Services ( HHS) would permit for lax or optional sponsor vetting for children and would not require sponsors ‘ criminal histories, including those involving drug abuse, neglect, or abuse, to be necessarily considered as a prerequisite for child welfare concerns.
According to Manchin’s office, the administration’s new rule does n’t require a sponsor to inform law enforcement about their immigration status, but instead imposes “weak standards” for postrelease home studies to assess a child’s welfare while the sponsor is in the care of the sponsor.
Manchin also objectes to constraints on reporters ‘ ability to reveal system misconduct to Congress and the Health and Human Services investigator standard.
According to HHS, when immigration officials apprehend a child who enters the country without a parent or legal guardian, they move the child to the Office of Refugee Resettlement until the baby is released to a partner, who is typically a family member, to rush for courtroom proceedings.
Partners may be determined to be reliable in terms of ensuring a child’s well-being, and all donors may pass background checks.
HHS officials praised the rule’s progress over the 1997 Flores Settlement Agreement when it was announced in April, setting new standards for location and launch of unaccompanied children, crisis and flood operations, transport, and monitoring requirements.
HHS Secretary Xavier Becerra cited the “unwavering devotion to the health, security, and happiness of unsupervised children in our attention.”
We established clear criteria for the care and treatment of unsupervised children in ORR’s prison and the support they receive as they make their way to new areas, he added, by strengthening the legal foundation governing the UC Program.
Manchin has the power to take the decision before the Congressional Review Act and compel a vote despite the opposition of his acquaintances. It cannot be filibustered.
To reverse the government’s new law, the magnification would need to be signed by the president and passed by both the Senate and House.
