How Biden could keep Hunter out of jail without breaking no pardon pledge

Following his new faith in a felony firearm test, President Joe Biden vowed never to forgive his son, Hunter Biden. However, the president also physically maintains another clemency avenue to support his only surviving son avoid jail time.

Since 2021, Joe Biden has utilized his political mercy power 154 days, cut into 24 clemency and 130 switching. A forgive would eliminate all or some of the repercussions of a criminal conviction, but transmission results in a shorter prison term.

Judge Maryellen Noreika, who was appointed by former President Donald Trump in 2018, has yet to set a sentencing time following Hunter Biden’s June judgment. He is facing a maximum sentence of 25 years in prison, but because he is a first-time offender, he is likely to receive a much shorter statement.

Joe Biden stated in a speech on Tuesday that he would “accept” the trial’s goal and that he had previously pledged not to forgive his son. White House press secretary Karine Jean-Pierre evaded a number of concerns about the government’s particular speech on Wednesday and whether a transmission might still be “on the table” for his child.

” I have not spoken to the president about this, but what I’m saying is that he was questioned about a pardon,” he said. He was asked about the trial specifically, and he answered it very clearly”, she said in one exchange. I do n’t have anything beyond what the president said.

Multiple veteran Democratic operatives with knowledge of the Biden team’s thinking told the Washington Examiner that Jean- Pierre’s response was more about” not getting ahead” of the president or Hunter Biden’s own sentencing than it was about any specific responses to that sentence.

” President Biden and this White House respect the rule of law, and there’s a process that needs to play out here”, one strategist explained. ” The press wants to take Karine’s words and turn that into a new story when in reality, the president and his team do n’t want to influence the judge’s sentencing”.

” Simple caution when dealing with reporters is something we’ve seen from the Biden White House on numerous occasions over the years. A second strategist explained that I expected Karine to be aware that this is a personal matter for President Biden and that he would want to clarify it on his own.

Two additional Democratic insiders predicted that Joe Biden would state explicitly that his intention to not pardon Hunter Biden includes not commuting his sentence once he travels from Italy. One of those people claimed that the president is currently concentrating on ensuring coordination with other G7 leaders regarding the conflict in Ukraine.

On Thursday, Biden will meet with Ukrainian President Volodymyr Zelensky, and the two will hold a joint press conference right afterward.

” We all know that President Biden has a lot of feelings for his son, and this has had a significant impact on the family,” Biden said. But let’s be honest for a second. There is a very slim chance that Hunter Biden’s sentence will result in any lengthy jail time, and one strategist predicted that the president would not take the risk of influencing voters ahead of November in order to help his son escape a small amount of trouble. ” Hunter is an adult. He’s overcome his demons, but the problems he’s currently facing are far greater than the danger the nation faces if Trump wins in November. That fact is acknowledged by the entire Biden family.

Jordan Rubin, a legal expert and writer of NBC News’s Deadline: Legal Blog, similarly wrote that Joe Biden’s vow not to pardon his son was likely a blanket statement referring to all clemency actions.

The notion that the president’s preemptive position on a pardon was allegedly rooted in his refusal to appear as though he would receive preferential treatment was suggested. Of course, vowing not to pardon a certain defendant ahead of time is actually giving the president’s son worse- than- average treatment because it involves prejudging his eligibility before he has served any time or, obviously, submitted a clemency application”, Rubin claimed. ” That aside, if the president’s reasoning behind ruling out a pardon is of the no- one- is- above- the- law variety, then taking any action in his son’s favor could cut against that.

Rubin did claim that if Judge Noreika sentences his son to a” truly draconian” sentence that goes beyond the typical sentencing guidelines, the president may order him to receive a commutation.
