
A local prosecutor in Little Rock, Arkansas has concluded agents with the U. S. Bureau of Alcohol, Tobacco, Firearms, and Explosives ( ATF ) used appropriate lethal force when they shot and killed airport executive Bryan Malinowski on March 19.
” On April 23, 2024, the Sixth Judicial District received the investigative review file from the Arkansas State Police ( ASP) regarding the officer involved shooting incident that occurred at 4 Durance Court, Little Rock, Arkansas on March 19, 2024″, Pulaski County Prosecutor Will Jones , announced , on Friday, June 14. ” After a review of the papers, remarks, and information provided, we find that the owner’s use of lethal force was justified contrary to Ark. Code Ann. § 5- 2- 610″.
Around 6 a.m. on March 19, ATF officials and Little Rock Police Department officials participated in the attack. Immediately before breaking down Malinowski’s doorway and killing him, the law enforcement team at Malinowski’s house covered over a door camera.
Congressional Republicans and Malinowski’s family have questioned aspects of the attack and whether ATF agents correctly identified themselves or provided good linguistic warnings before Malinowski reportedly met them with deadly pressure inside his home.
Jones claimed the Little Rock Police Department’s Mobile Video Recorder was present and recorded some of the events of the raid, despite the U.S. Department of Justice indicating that the officers and agents involved in the raid were n’t wearing body cameras. Jones provided the following fresh timeline of events, based on this reported tracking:
- 6: 02: 58 a. m. The Little Rock police agent employed his car emergency lights and loud to reveal the presence of law police.
- 6: 02: 59 a. m. ATF officials began a series of knocking and announcing Grant presence.’
- 6: 03: 27 a. m. Agents use a computer to misconduct the entrance.
- 6: 03: 43 a. m. Mr. Malinowski fires the first of four pictures from his Colt Defender.45 ability semi- automated weapon.
- 6: 03: 44 a. m. ATF representative returns fire, discharging three bullets from his agency issued M4.
According to the account of a witness who he did not identify, Jones also provided a more in-depth account of what transpired when ATF agents entered Malinowksi’s house.
Officials entered the doorway using a battering ram after knocking and announcing their appearance. The officials were wearing bullet-proof jackets with” ATF POLICE” across the front, dark coloured tops with the ATF protect imprinted on the left side, and khaki pants with the word” ATF POLICE” imprinted on the right side. The agent who entered the home, Agent 1, glanced to his left and saw Mr. Malinowski pointing the gun at him at the end of the doorway. The broker instantly rolled to the ground and dropped to the ground to avert gunshot wounds. Mr. Malinowski fired downwards at Agent 1 as the second agent came in ( Agent 2 ) At this time, Agent 2 was struck in the legs. As Mr. Malinowski raised his weapon towards Agent 2, Agent 2 fired, striking Mr. Malinowski. Soon after the shooting, officials requested emergency employees and begin administering health support to Mr. Malinowski”.
According to Jones, a law enforcement official is justified in using lethal natural force if he or she believes that the officer needs to protect himself or another person from the use of lethal force.
Jones did not specify the rhetorical instructions that law enforcement officials and officials gave.
The ATF officials apparently knocked on his entrance and announcing their presence before ramming down his door in a 28-second space, according to Bud Cummins, an attorney representing the Malinowski home.
How long is it acceptable to wait for someone to knock on someone’s front door at 6 a.m. in a 3, 000 square foot, fully insulated house to stop loud pounding? Let’s pray the answer is n’t 28 seconds. The Fourth Amendment means more than that to every single one of us”, Cummins said in a , statement , shared with various media outlets.
Despite Jones ‘ claims that the ATF agents used deadly force in a responsible manner, Cummins claimed that the Malinowski family’s questions and concerns about the raid are “far from over.”
