Two academics are subject to federal court’s sanction.
A federal court upheld the university’s right to discipline two academics who circulated flyers racially bias against other academics.
The now-expiring sanctions against faculty Julia Gruber and Andrew Smith were upheld by a three-judge section of the Sixth Circuit Court of Appeals.
The complaint alleged First Amendment violations and the violation of [Provost Lori Bruce ]’s order to control Gruber and Smith after they distributed brochures on campus, according to the decision.

The flyers included a photograph of another professor, Dr. Andrew Donadio, and stated that ( 1 ) Donadio is a racist who was helping start a chapter of Turning Point USA at TTU, ( 2 ) Turning Point USA is a national hate group that allows racist students to unite to harass, threaten, intimidate, and terrorize minorities and other groups, and ( 3 ) Donadio and Turning Point USA are not welcome at TTU.
As recently reported by The College Fix, a federal prosecutor upheld the punishment in 2022.
The Fix reported:
Smith and Gruber were” never permitted to serve as a university assistant to any student businesses” nor “allowed to participate in study abroad actions”, according to Judge Crenshaw’s description of the sanctions. Additionally, both were “ineligible for wage increases for a month” and “ineligible for non-instructional faculty projects.”
Dean Bruce and the judges agreed with the judge that the institution is concerned about preserving “harmony among coworkers.”
Both Donadio ( pictured ) and TPUSA members were harmed by the racism accusations, according to the latest ruling.
” For instance, one Turning Point USA part, having been deemed a sexist, missed school because of the fallout”, the choice stated.
” In contrast, the charges affected the plaintiffs ‘ success in the classroom”, the choice stated. Individuals in the league, or those considering joining the team, who were enrolling in classes with Gruber and Smith might fairly be concerned about the possible treatment they may collect in school because of their opposing political views.
The flyers, which attacked a teacher and pupil firm and stated that they were not welcomed on campus, posed a real risk of compromising TTU’s educational mission and are the kind of speech that a learning institution has a strong interest in preventing, are
