In the wake of the recent political debate, Joe Biden’s performance gave Democrats the opportunity to say the silent part out loud and begin to raise public concerns about renominating the current leader in the wake of obvious evidence of his physical and mental decline. But those concerns should range far beyond the (understandable ) worries about Vice President Kamala Harris ascending to the presidency.  ,
A position in the administration was change the balance of power in the legislative branch as well, given the razor-sharp margins in Congress over the past few years. Some people appear to have taken the time to consider the ramifications of appointing a successor vice president after considering the idea of replacing a president midterm.  ,
Reduction of Party Control ,
Consider the situation in January 2021 at the time of Biden’s opening. In addition to capturing the president, Democrats retained control of the House of Representatives by a small 222- seat lot. Democrats regained control of the Senate when Harris took the oath of office as vice chairman, resulting in a 50-50 knot after the two Georgia runoff votes that quarter.  ,
At the time of his 2021 inauguration, Biden became the oldest leader in American history. The effects of Harris ‘ illness during the 117th Congress may have gone way beyond putting him in the Oval Office.  ,
Part 1 of the 25th Amendment plainly states that upon the demise of the leader,” the Vice President shall be President”, meaning Harris would have become main professional immediately.  ,
However, a majority in the Senate would have been created by elevating Harris to the president, which would have caused a total 50-to-50 cut.  ,
A process known as the” who shall acquire business upon validation by a majority vote of both Houses of Congress” is provided by the 25th Amendment. However, in this case, Democrats would have needed to secure at least one Republican vote to ensure a fresh vice chairman, given an equally divided Senate.  ,
Under these conditions, senators may have faced tough cross- pressures. Given growing dangers from China and Iran, leaving the vice president vacant until the next presidential vote, may range from difficult to unsafe for national security reasons. However, any Senate Republican who voted to install Harris ‘ alternative may have faced a sluggish and immediate reaction for using that vote to veto controversial legislation through Congress, and at least one Republican would have had to do so in a 50-50 Senate.  ,
In exchange for some Senate power-sharing agreement that would stop Democrats from using the new vice president’s tie-breaking vote to ram through a partisan agenda ( i .e., the kind they spent much of 2021- 22 enacting ), Republicans could agree to support a consensus nominee for vice president, such as one with broad bipartisan backing. Some Democrats, who doubtless oppose Republicans using a president’s death to sway their political agendas, would find it even more revolting in this situation.  ,
‘ Black Swan ‘ Celebration?  ,
Although this kind of situation has never received little, if any, promotion, it still has a real realism to it. In fact, either group may find themselves in a position where only the vice president’s tie-breaking vote maintains control of Congress given the country’s polarization and the tightness of the November election.
When the next Congress enacts in January, either party’s majority in the House of Representatives is likely to be limited to a select few members.  ,
Democrats appear to have leads in most other contests, meaning they may hold onto 50 Senate seats, with the party’s power of the vice presidency determined by which party has the most seats in the Senate. Republicans have more chances than Democrats of picking up Senate seats, and they are almost certainly going to pick up Sen. Joe Manchin’s seat.  ,
Donald Trump is many times younger than Biden, but he would be older than Biden was when he took office in January of that year. He would also be older at the end of his presidency than Biden is now.  ,
Control of the Senate, and integrated control of Congress, had come down to which specific occupies the business of vice leader. A drop in the two oldest major-party candidates for president, by emphasizing that political balance, could lead to unknown constitutional and political territory for the nation.  ,
