It’s difficult to sit around and make substantial arguments against the Democrats ‘ Supreme Court “reform” plan, since anyone knows it’s only a , cynical ploy , to vilify both the court and the Constitution.
Ask yourself this: had any Democrat support the government’s court-packing system if they believed Republicans would earn both Houses and the president? Of course no. It’s Calvinball all the way along.
And , it is , a judge shipping system. a constitutional one. One imagines the name” court packing” has n’t polled very well with the government, so Joe Biden — or whoever’s running the White House these days — signed off on a secret program. An 18-year term limit for justices , did, quite easily, turn a 6-3 originalist majority into a 6-3 “living and breathing document” majority that would overturn some new decisions, and rubber stamp a slew of governmental abuses.
Given that there are virtually no chances of the transformation package being passed, one might say it’s all just an election gimmick. That’s not the place. The Supreme Court’s refusal to support loyalists has become a norm given the idea that it is both illegal and corrupt.
After all, none of the media’s concerns are grounded in anything resembling a constitutional discussion. The court’s full case revolves around the feckless notion that it is failing because it rejects Democrats ‘ democratic principles. They do n’t even care that the law is neutral, let alone the law itself. The modern communist has no limiting beliefs and is moral.
Speaking of authoritarians. According to Kamala Harris,” the Supreme Court is facing a clear crisis of confidence.” Is there?
First off, we find ourselves here because of decades-long strikes on the organization. Since the 1980s, Democrats have mocked assurance sessions. Things actually started happening after Barack Obama formally criticized the Supreme Court for upholding the First Amendment.
Rich liberal activist groups started putting together fake scandals and laundering them using fake news gatherings. The media is then affix the term “plagued by drive scandals”, or some such nonsense, to every mention of the courtroom. If there is any crisis of confidence, it’s because the remaining concocted one.
Yet still, as Casey Mattox , thoughtfully points out, Gallup finds that 30 percent of Americans have a” Great Deal/Quite a Ton” of confidence in the Supreme Court. In the last two decades, the figure has substantially increased. Another 31 percent say they have” Some” trust in SCOTUS.
But, let’s set aside that nasty Article 3 of the Constitution for a moment. If voting is the reason for stripping the freedom of a branch of government, why do we help Congress, with its 9 percentage trust standing, to do it?
A password of criminal conduct is already in place by judges. None of them have engaged in unethical behavior on the chair that directly benefited a third party, significantly less themselves. Judges have no reason to believe that they have abandoned their long-held legal theories for any cause, whether for vacation or for whatever reason.
Additionally, it’s important to keep in mind that Democrats created a number of brand-new criteria to disparage Clarence Thomas. Most criminal commission users leading the charge to vilify the court have traded in on their status to strengthen themselves, including , Dick Durbin, Vietnam War fabulist , Richard Blumenthal, crime theorist , Sheldon , Whitehouse,  , and , Peter Welch.
Perhaps SCOTUS should be writing ethics regulations for Congress, from what I’m seeing.
Democrats want to establish an ethics code to make it easier for partisans to slander justices in yet another congressional show trial and false investigations armed with the most recent garbage Politico or ProPublica is producing for its progressive funders. Sorry, the Supreme Court is an equal branch of government. Chuck Schumer is free to , threaten , justices, but they still do n’t answer to him.
They also do n’t respond to Biden, whose wealthy family ran a shady influence racket. The presidency, incidentally, has a 26 percent confidence rating with Gallup. The media, deservingly, is near the bottom of the list. In reality, Americans have more faith in the Supreme Court than they do state-run nonprofits, unions, big businesses, banks, or the criminal justice system.
” What is happening now is not normal, and it undermines the public’s confidence in the court’s decisions, including those impacting personal freedoms. We now stand in a breach”, Biden says.
Democrats only care about legalizing abortion on demand into the ninth month, which is their only “personal freedom.” Just say , Dobbs, because I ca n’t think of a single individual liberty the contemporary left wants to safeguard or enhance.
The president is correct to point out that the court has historically upheld the Constitution. Even then, majority concurrences are  , quite diverse. The idea that textualists walk lock step more often than left, as the previous session demonstrated, is a complete fantasy.
The president, by the way, has been in government since 1973. The Democratic-controlled Senate currently has over 70 % of its members over the age of 70. Durbin, the chairman of the judiciary, has served in Congress since 1982.  ,
The lifetime appointments of justices are intended to protect the high court from political debate’s whims and opulence. The Supreme Court’s performance in its role is exactly what bothers the left the most: it is doing its job. The process would turn into a more obscene partisan mess if we had no idea when confirmation votes would take place. That, again, is exactly what the anti-norm leftist desires.
Indeed, the Democrats ‘ plan , to pack , the Supreme Court, the last , properly functioning institution in D. C., is an attack on the constitutional order, and its long-term consequences are far more corrosive than anything that happened on Jan. 6. It’s not even close, really.
