A Californian gentleman who has a history of political assault was given a 20-year prison sentence on Friday for constantly kicking officers with lampposts and other wooden weapons during the US Capitol riot on January 6, 2021.
David Nicholas Dempsey’s word is among the longest among thousands of Capitol riot trials. He was referred to by the prosecution as one of the most aggressive members of the Donald Trump supporters ‘ crowd who attacked the Capitol as legislators gathered to declare Joe Biden’s victory in the 2020 presidential election.
Dempsey, who is from Van Nuys, stomped on police officers ‘ eyes. According to the prosecution, he allegedly attacked police with pepper spray and damaged furniture, hit an officer with a copper crutch, and swung wires at officers defending a pipe.
He climbed atop another protesters, using them like “human scaffold” to reach soldiers guarding a tunnel access. He injured at least two police officers, lawyers said.
” Your conduct on January 6th was exceedingly egregious”, US District Judge Royce Lamberth told Dempsey. You did n’t get carried away at the time, I assure you.
In January, Dempsey admitted to two counts of dangerous weapons assault against authorities.
Enrique Tarrio, the only original Proud Boys head, served a longer prison term in the attack on January 6. After the 2020 presidential election, Tucker was given a 22-year sentence for plotting to prevent the peaceful transfer of power from Trump to Joe Biden.
Dempsey called his do “reprehensible” and apologized to the police soldiers whom he assaulted,
” You were performing your duties, and I responded with hostility and violence”, he said before learning his word.
Previous fast-food restaurant staff Dempsey, a former construction worker, and prisoner of 21 times and 10 months, was advised by justice ministry prosecutors. According to the prosecution, Demompsey attacked a fellow guy who was attempting to subdue him because his murder was so violent.
” David Dempsey is political crime personified”, Assistant US Attorney Douglas Brasher told the judge.
Defense attorney Amy Collins, who sought a word of 6 years and six months, described the president’s punishment suggestion as “ridiculous”.
” It makes him a statistic”, she said. ” It does n’t consider the person he is, how much he has grown”.
When he attacked officers at a pipe leading to the Lower West Terrace windows, Dempsey was covered in an American emblem told, military vest, and hat. According to the prosecution, he reportedly pepper-sprayed Metropolitan Police Department Detective Phuson Nguyen as another guy yanked at the policeman’s gas helmet.
” The searing apply burned Detective Nguyen’s lungs, mouth, eyes, and face and left him gasping for breath, fearing he might gain awareness and become overwhelmed by the mob”, they wrote.
Dempsey therefore struck MPD Sgt. Jason Mastony struck him in the mind with a metal stick, cut his head, and sever the shield from his gas mask.
As my lips rang, I fell and slammed against the walls. In a speech to the jury, Mastony said,” I was able to have again and hold the line for a short while until another assault by protesters pushed the police line backwards from the tunnel’s level.”
Since his imprisonment in August 2021, Dempsey has been in prison.
His criminal history in California includes views for burglary, fraud and abuse. According to prosecutors, the rape conviction stemmed from a protest in October 2019 that took place close to the Santa Monica Pier. Dempsey calmly attacked demonstrators against then-President Trump.
Dempsey was given a 200-day prison term, and according to their writing,” the peaceful opposition turned violent as he took a bottle of bear spray from his pants and dispersed it near some protesters.”
Dempsey engaged in at least three other acts of “vicious political violence” that did n’t lead to criminal charges” for various reasons”, according to prosecutors. They said Dempsey struck a counter-protester over the head with a skateboard at a June 2019 protest in Los Angeles, used the same skate to assault people at an August 2020 rally in Tujunga, California, and attacked a rebel with pepper mist and a metallic bat during a August 2020 protest in Beverly Hills, California.
More than 1, 400 people have been charged with Jan. 6-related national acts. More than 900 of them have been found guilty and sentenced, with the majority of them serving prison sentences as short as the 22-year-old Tarrio has already served.
