The power struggle continues over Title IX and the Biden-Harris administration’s push to put boys in girls’ bathrooms and marginal male athletes on women’s teams.
A Supreme Court decision last week prevents the administration from enforcing the measure in certain states and individual schools named in several legal challenges of the rule. For now, those named schools do not have to implement the so-called Title IX “Final Rule.”
Despite that decision, the Pennsylvania College of Technology, which is named in a case in which an injunction has been issued, told staff and faculty in a Friday meeting that the college will implement the rule, claiming it is required to do so.
“There is a new requirement for discretionary reporters that are really important for us, because we have to meet federal requirements in order for us to receive federal aid and support, and it’s the right thing to do for our students,” President Michael Reed told staff and faculty in a Friday meeting, according to a recording of the meeting provided to The Federalist. “Now all groups are required to inform the Title IX office when made aware of a student’s pregnancy.” That is just one of many ways the Final Rule will be felt.
He promised more details in a Title IX training to come. Reed’s office did not respond to a request for comment on why the college is implementing the Title IX Final Rule when the court has allowed named schools to wait.
The original, 1972 Title IX prohibits “discrimination based on sex in education programs or activities that receive federal financial assistance.” That is already the law of the land. The Biden-Harris administration tightened the 1972 policy to include “sexual orientation and gender identity discrimination” in its Final Rule, which went into effect Aug. 1. It means schools found “discriminating” could lose their federal funding.
Discrimination could now include preventing a boy from joining a girls’ sporting team, or “misgendering” someone — referring to him as “he,” when he wanted to be called “she” that day. There are no limits on how many times a person may claim he is a different sex. That worries Karen DiSalvo, an attorney and an assistant professor at the Pennsylvania College of Technology, because of the First Amendment, free speech implications.
“If I misgender someone or use the wrong pronouns — and keep in mind they can change from day to day — that could result in a harassment claim, and I could lose my job, or a student could be kicked out of school,” DiSalvo told The Federalist. “If I say there are two sexes, or I have a student who gives a speech, and they say there are two sexes, or they say sex and gender are the same, or if I have a student who says that sex is immutable or unchangeable, it’s now unclear whether those statements in a classroom setting could result in harassment claims by students who are offended by those statements.”
Pennsylvania College of Technology is one of the schools covered by the injunction issued in Kansas v. U.S. Department of Education. In that case the U.S. District Court for the District of Kansas found the Final Rule “violates the First Amendment by chilling speech through vague and overbroad language.” Moms for Liberty, Young America’s Foundation, and Female Athletes United are involved in the litigation seeking to prevent the implementation of Title IX’s Final Rule.
The court told these groups to produce a list of schools its members’ children attend, to establish standing in the case. The court’s decision applies only to the four states that went to court and the 1,100-plus institutions listed by Moms for Liberty, Young America’s Foundation, and Female Athletes United. Institutions covered by the injunction do not have to implement the Title IX Final Rule because the Department of Education cannot enforce the rule by removing federal funding related to the Title IX Final Rule. In total, injunctions in six lawsuits now completely block DOE enforcement of the Final Rule in 26 states.
