A Pennsylvania professor who was fired for reportedly attending the U. S. Capitol “insurrection” on January 6, 2021, has won a wrongful termination complaint after a two-week test.
Jason Moorehead, a 17-year former social studies teacher in the Allentown School District, had generally maintained that he was “at all times more than a mile away” from the Washington Monument at the time of the mob.
However, the city announced in a news release on January 7 that a city employee had “been involved in the electoral college protest.” Superintendent Thomas Parker did mention that the city “has an commitment to honor our staff’s First Amendment right.”
The city can work in a way that “balances First Amendment right with the higher criteria set for public school teachers,” according to District Solicitor John Freund, who also claimed that “only after knowing all the information” the area could do so.
These criteria include “teachers ‘ duty not to advocate or participate in un-American or revolutionary doctrines.”
Lehigh Valley News.com reports the district also” saw]Moorehead’s ] light-hearted comments” on social media about the happenings at the Capitol.
For example, in response to a post which said” Do n’t worry everyone, the Capitol is insured”, Moorehead wrote” This”! The statement makes allusion to those who previously made similar remarks about the most devastating protests in American history following the death of George Floyd.
Although Moorehead was n’t especially named in the city speech, “outraged members of the public quickly identified him” as the alleged suspect. Some posted Moorehead’s photograph and home solve on social media.
The account CROH Lehigh Valley ( the first four letters in the phrase” Community Research Opposing Hate” ) stated on X ( then Twitter ) that Moorehead “was identified as an attendee of the J6 Capitol coup attempt” and that “his presence is sufficient reason for him to never teach# Allentown students ever again.”

The phrase” Students cannot be protected in a school with a nazi” was added.

During the inspection, Moorehead was “questioned thoroughly” by city authorities where, again, he insisted he was somewhere near the Capitol.
At the trial, the region claimed it had “attempted” to restore Moorehead — as long as he took a” social sensitivity” program. Moorehead refused, alleging the city had” created an uncomfortable, hostile work environment”.
He therefore was terminated.
Moorehead filed a lawsuit alleging that the area and several class board people had violated his civil rights by illegally suspending him in violation of the teachers ‘ collective bargaining agreement and by besmirching his title as a result of his liberal political leanings.
On Aug. 16, a judge awarded Moorehead$ 131, 500, most of which may come from the city. Two school board members, Lisa Conover and Nancy Wilt, are liable for$ 6, 000 and$ 500 respectively.
Moorehead had never specified a desired buck amount for “loss of income, loss of job, reputational injury, mental and emotional problems and suffering”, and punitive problems.
In a statement, Moorehead’s attorney, AJ Fleuhr, said that the Allentown School District “violated Jason Moorehead’s First Amendment rights to free speech, council, and social affiliation” and that the named committee members “maliciously and wantonly attacked him.
Fleuhr added” There was never any justification for]the district’s ] insidious and Orwellian course of action”.
