A legitimate issue filed on Wednesday alleges that Democrat Secretary of State Cisco Aguilar’s failure to comply with his constitutionally mandated duty to clear Nevada’s voter rolls may have allowed” thousands” of noncitizens who allegedly registered to vote in 2020 to continue to cast ballots, according to a legal issue.

The complaint claims that Aguilar is “violating his legal responsibilities to ensure that only people are registered to vote” and was brought by the Trump campaign, the Republican National Committee, the Nevada GOP, and a state citizen. Aguilar, the Democratic National Committee, and the Nevada Democratic Party are listed as plaintiffs in the case.

Nevada GOP Chair Michael McDonald said in a statement released on Thursday regarding the lawsuit that” the elections should be a reflection of its members ‘ accents, not influenced by non-citizens who have no legal standing to participate.” Any attempts to help non-citizens to cast ballots threaten the very basis of our elections and diminishes the authority of constitutional voters in our state.

According to the plaintiffs, state law requires that the secretary of state “has not adopted any guidelines or regulations that require the identification of a politician’s membership or the elimination of noncitizens from the vote rolls.” Further, they assert that “3, 987 people listed in the DMV noncitizen report cast a vote in the 2020 general vote according to information obtained in dispute involving the Nevada vote.”

That figure appears to be the result of a sworn affidavit Jesse Kamzol, a former RNC key information officer, filed in a 2020 election case. As previously described in the Epoch Times, Kamzol “matched the&nbsp, 110, 164 non-citizen records from the DMV, which were&nbsp, obtained through a lawsuit by the country’s Republican Party, against Nevada’s voting record …]and ] determined, with’ large to mid-high trust,’ that&nbsp, 6, 260 non-citizens were registered to vote and 3, 987 non-citizens had voted” in the Silver State’s 2020 contest.

The DMV file’s name suffix ( JR/SR/etc. ) was missing because of the birthdates. presence appeared to be contradictory, but false positive matches of like-named family/household members are feasible within these matches, but and again, these are all great to mid-high confidence matches that are dependable and merit further investigation”, Kamzol wrote in the affidavit.

The GOP allegedly requested evidence from former GOP Secretary of State Barbara Cegavske to provide the claim and other “fraudulent votes” in the state’s 2020 contest in early March 2021, The Nevada Independent reported.

Cegavske’s office responded to Republicans ‘ allegations, including those related to potential noncitizens voting, in an April 2021 report. Officials claimed they followed the GOP’s lead by requesting a “skala of individuals who presented an immigration document while obtaining a drivers ‘ license over the last five years” from the state DMV, which reportedly contained” a total of 110, 163 individuals.”

The report noted that 5, 320 of those individuals “were identified as active registered voters” and 4, 057 of those active registered voters “had a vote history from the 2020 general election”. However, Cegavske “nevertheless rejected these reports based on rumors that an uncountable number of people may have been naturalized between the date of their DMV transaction and the 2020 general election,” as stated in the plaintiffs ‘ Wednesday lawsuit.

” Without specific evidence to establish that identified individuals were foreign nationals when they voted in the November 3 election, there is nothing further that can be investigated”, Cegavske’s report reads. The generalized information obtained from the DMV cannot, in essence, be used as a foundation for an investigation into alleged voter fraud.

When pressed for comment on the allegations brought by Republicans and the Trump campaign, a spokeswoman for Secretary Aguilar told The Federalist,” Only United States citizens are eligible to vote in Nevada’s elections” and” ]t ] here are already numerous safeguards in place to prevent noncitizens, or anyone ineligible to vote, from casting a ballot”.

” Any claims of&nbsp, a widespread problem are false and only&nbsp, create distrust in our elections”, she said. ” The Secretary of State’s Office is focused on running successful, safe and fair elections on behalf of the voters”.

Plaintiffs requested a temporary injunction from Nevada’s First District Court that Aguilar “implement and conduct systematic and routine list maintenance that appropriately checks that registered voters are U.S. citizens” and that the secretary be required to finish these tasks prior to the November election. Additionally, they requested that the Nevada secretary of state be obligated to perform these duties under state law.
