A Georgia judge has ruled that the country’s six-week abortion ban is illegal, allowing abortions to be performed later in pregnancy. The choice, delivered by Fulton County superior court determine Robert McBurney on Monday, overturns the 2022 restrictions, reinstating the preceding control of 22 months for abortions, according to CBS News.
Georgia can no longer impose its contentious six-week restrictions, which became effective after the US Supreme Court‘s 2022 decision overturned Roe v. Wade, a landmark decision that once protected abortion rights in the US. A flood of pregnancy restrictions were imposed nationwide as a result of this decision. The moratorium, passed in 2019, prevented abortions after prenatal heart activity was detected, usually about six weeks —often before some women know they are female.
In his attempt, McBurney acknowledged the government’s interest in protecting “unborn” existence but noted that a person’s rights may take precedent until the foetus may succeed individually. ” The State’s interest in protecting’ newborn’ life is powerful, but until that life may be sustained by the State, the harmony of right favours the woman”, he wrote.
Additionally, the prosecutor argued that women should be free to choose what they want for their body. The right to decide whether they serve as human startups for the five months leading up to viability means that these women’s freedom of private means that they are the only ones to do so, McBurney said. ” It is not for a senator, a judge, or a Commander from’ The Handmaid’s Tale’ to remind these people what to do with their body”.
Following the Supreme Court’s ruling to rescind federal protections for abortion rights, Georgia’s abortion law, one of the utmost in the US, was passed. The state’s pre-ban position, which allows pregnancies up to 22 months, is restored by the ruling in Fulton County.
