The federal government is able to deport illegal immigrants, yet if local officials try to obstruct the deportation process, according to a three-judge section on the Ninth Circuit Court of Appeals.
Following King County Executive Dow Constantine’s executive order in 2019, county officials were instructed to forbid “fixed base operators” ( FBO ) on county airports from escorting illegal immigrants who are lawfully removable. FBO’s “lease area from the airports and offer flights with essential services, such as boosting and getting stairs”, according to the decision.
The Trump administration filed a lawsuit because the purchase prevented ICE from enforcing the law and removing improper immigrants. The administration claimed that the attempt was infringed on a World War II-era deal that gave the federal government access to the King County airport and the Supremacy Clause of the Constitution.
The three-judge board affirmed both assertions. The board determined that the professional buy “improperly regulates the way in which the federal government ships noncitizen prisoners by preventing ICE from using personal FBO companies at Boeing Field” and that it was in violation of the Supremacy Clause’s international immunity theory. The jury also ruled that the executive order “regulated ] the federal government negatively on some grounds relating to their governmental’status.”
According to The Seattle Times, King County stated that it would not contest the decision.
While hordes of so-called” shelter cities” all over the country oppose the protection of federal immigration laws and go so far as to refuse to comply with ICE authorities, the incoming Trump presidency has pledged to resolve the border crisis and deport illegal immigrants who are draining taxpayer resources.
Tom Homan, dubbed the approaching “border czar”, has previously warned shelter city leaders not to resist or restrict the federal government’s imprisonment activities.
It is illegal to knowingly suppress an illegal immigrant from immigration officials or to harbor them. Don’t analyze us”, Homan said.
One Democrat, Denver Mayor Mike Johnston, has already vowed to galvanize officers and people” stationed at the state line” to “keep” federal immigration officials “out” of the area. Johnston later tried to walk back the comparison, drawing comparison to Tiananmen Square.
Homan responded to Johnston’s open defiance, saying he is “willing to put]Johnston ] in jail”.
