The Biden-Harris government’s attempt to expand Title IX protections for trans kids on the basis of “gender identity” was struck down on Thursday by a federal judge in Kentucky.
In Cardona v. Tennessee, the U.S. District Court Eastern District of Kentucky Northern Division made the news on Thursday. Thursday’s ruling came after the Biden-harris management issued a new concept in April that expanded” sexual bias” to include discrimination based on sexual orientation, gender identification, and “pregnancy or related circumstances”.
The Biden-Harris government’s expansion of Title IX may have allowed natural men to play in children’s activities and have allowed them to use women’s restrooms and locker rooms, according to The Daily Wire.
Over two hundred attorneys general filed a complaint against the Biden-Harris government’s Title IX expansion, warning that it would conflict with state laws prohibiting transgender people from competing in women’s sports, according to Fox News.
The U.S. District Court Eastern District of Kentucky Northern Division wrote,” When Title IX is viewed in its entirety, it is abundantly clear that discrimination on the basis of gender means prejudice on the basis of being a male or female,” in an view accompanying the decision on Thursday. As this Court and others have pointed out, “turning the meaning of “on the base of sex” to contain “gender identity” turns Title IX on its mind.”
The prosecutor argued that while Title IX was meant to “level the playing area” between men and women, the law is “rife with exclusions” that allow for men and women to be” separated based on the enduring real differences between the sexes.”

The court added,” Because the Final Rule and its corresponding regulations exceed the Department’s authority under Title IX, violate the Constitution, and are the result of arbitrary and capricious agency action, the plaintiff’s motions for summary judgment will be granted and the Department’s motion for summary judgment will be denied”.
Attorney General of Tennessee Jonathan Skrmetti praised the court’s decision in a post on X, formerly Twitter, calling it a “massive win” both for the state and the nation.
” The court’s order is resounding victory for the protection of girls ‘ privacy in locker rooms and showers, and for the freedom to speak biologically-accurate pronouns”, Skrmetti said.
Sen. Bill Cassidy (R-La ) criticized the Biden-Harris administration for” completely losing its way on Title IX” in a statement obtained by Fox News. By “removing longstanding protections that ensured fairness for women and girls,” Cassidy claimed, the administration “betrayed” the original purpose of Title IX.
