As competitors and supporters of Trump’s policies wait patiently for them to take effect starting on Monday following his oath of office, his plans, including mass deportations and illegal immigration curbs, have suscité much controversy.
After being sued several times during his first term, the American Civil Liberties Union vowed to take legal action against Trump and his upcoming policies.
Four officials from the transition team and the new administration who spoke with The Washington Examiner privately spoke about where Trump will attack first.
What to anticipate for year one
- Restart Remain in Mexico ( formerly the Department of Homeland Security’s Migrant Protection Protocols )

” It is a funding issue. As long as the money was not specifically designated for something else, it can be diverted. However, the brunt of it will have to be voted on”, said the first official.
- Build the border wall again
Trump will demand the funds to finish the border wall through the National Emergency Act by the following week, but three officials believe it may not be necessary.
The GOP-led House and Senate did not compel Trump to pay the billions of dollars he requested, and this time, the White House is more adept at closing deals than it did eight years ago.
However, times have changed since 2017. Last week, even Democrats crossed the line to support a conservative bill known as the Laken Riley Act, a show that some Democrats may even be willing to sign a check to better guard the country’s borders.
As part of its executive actions in 2017 to stop illegal immigration, the Trump administration promised to build a comprehensive physical wall between the United States and Mexico right away. Many complications, including multiple lawsuits, poor planning, challenges obtaining private land, and a cash flow shortage, kept that plan from becoming a reality.
The Washington Examiner visited all four southern border states to see how many projects had been completed with the$ 15 billion in funding that the White House had obtained through legitimate and covert means in the days leading up to the 2020 presidential election.
Roughly 700 miles of the 2, 000-mile border had some sort of wall when Trump took office, and when he left, he had installed 400 miles of barrier, including large portions that replaced short and shoddy rusting barriers.
By the time he left office, an additional 300 miles of the border barrier had already been completed, and only 740 miles of it were still closed, leaving a significant portion of the open and potential for a fight to win billions of dollars.
After taking office in 2021, Biden halted all wall construction, leaving billions of dollars worth of 18- and 30-foot steel beams rusting away at construction sites across the border.
- Shutter the CBP One app
Trump , will immediately make good on his promise to do away with the Biden administration’s CBP One app, which allows , immigrants , to apply for admission to the country through programs that circumvent normal means.
“CBP one app is gone day one”, said the first official.
In early 2023, the Biden-Harris administration added two additional features to the app that made it possible for immigrants to apply for admission from outside the country or meet with a US customs officer. Republicans have criticized the move as a backdoor to allow hundreds of thousands of people to enter the country in less than two years because it was intended to give immigrants a way to seek admission without illegally crossing the southern border between ports of entry.
The CBP One app permits immigrants from four countries, Cuba, Haiti, Nicaragua, and Venezuela, to apply to enter the U. S. on parole, which allows an individual to remain for two years and receive a work permit. The recipient must pay for their international commercial flight and have a sponsor in the United States. More than half a million people have been admitted since the process was fully implemented in January 2023.
The second purpose of the app allows immigrants from Mexico to schedule appointments with U.S. customs officers at a land port of entry on the southern border. Up to 1, 450 appointments can be scheduled daily, for a total of more than 43, 000 per month. Immigration agents who schedule appointments are overwhelmingly accepted at one of the eight immigration offices that have been used for appointments for months.
” Termination of the program could threaten that deal, limiting the ability of the U. S. to address migration from countries such as Venezuela which limit deportation flights”, said Aaron Reichlin-Melnick, senior fellow at the American Immigration Council in Washington, in a previous story.
- End birthright , citizenship , for would-be Americans
Trump vowed in a recent interview with Kristen Welker of NBC News ‘s , Meet the Press , to walk back the 14th Amendment, which automatically gives any person born on U. S. soil American citizenship.
” If we can, through executive action. I intended to do it through executive action [during the first term], but we had to fix COVID first, to be honest with you. It needs to be ended, we must. It’s ridiculous”, Trump.

Trump did not answer Welker’s follow-up questions about the “inevitable” legal challenges.
” We have to get rid of this system. It’s killing our country”, Trump finished.
- Returning to the term “illegal alien” instead of “undocumented immigrant”
One of the first actions that Trump will put in writing, though not expected on Day One, is rescinding the Biden administration’s ban on the term “illegal alien”, a move that he views as undoing the Biden administration’s politically correct , immigration , language to , talk about illegal immigrants.
Federal police are not expected to continue under the Biden standard past Monday, regardless of the Department of Homeland Security’s order or internal memo.
” I don’t see anyone at]U. S. Immigration and Customs Enforcement ] or]U. S. Customs and Border Protection ] using any euphemisms for illegal aliens after Jan. 20″, the official said.
- Sanctions against nations that refuse to repatriate deportable citizens
According to a third source who spoke in transition conversations about homeland security policy, sanctions are not about when and how many, but rather when.
” Expect that to be something big because there are those countries that are going to say,’ Nope, we’re not taking our people back,'” the official said. ” There can be sanctions, State Department sanctions. If you don’t take back people from your country of origin”.
Cuba, a fourth official said, will be a definite recipient of sanctions come Monday.
Venezuela will have a few days to weeks to decide whether or not it will permit the Trump administration to repatriate its own citizens.
The Venezuelan government will have to make a serious decision, the fourth official predicts.” As soon as ICE has a number or more of Tren de Aragua gangsters in custody with removal orders,” the fourth official predicts. One of the gang’s members was found guilty in the February rape and murder of Georgia nursing student Laken Riley.
Texas has already detained four members of the Tren de Aragua gang, according to governor. Greg Abbott (R-TX ) would likely be able to quickly turn himself in and leave his state and the nation.
Sanctions out of state could come in the form of ceasing to issue visas, even tourist and visitor visas — moves that Sen. Marco Rubio (R-FL ), Trump’s secretary of state nominee, is said to support.
” Think of the threat to China and how it would affect people if they don’t start welcoming all the tourists who want to visit and all the people who want to visit for espionage reasons, and all that other stuff.” So really expect that to be a big focus”, said the third source.
