A scholar is suing the University of Chicago for putting him on an “involuntary leave of absence” and forcing him to leave campus housing late next year.
In his complaint, top Manuel Rivera accuses UChicago, Interim Dean of Individuals Michael Hayes, and” two unnamed UCPD soldiers” of” Unlawful First Amendment Retaliation” and ,” Unlawful Expulsion in Tort”, according to , The Chicago Maroon.
In accordance with 42 U. S. C. 1983, Rivera may sue police officials for “participating in the hunger of his legal rights by carrying out his removal from cover,” according to Chicago Municipal Code 5-12-160, which regulates employer interference with residents ‘ access to buildings.
According to Rivera’s issue, he reported that he “reported seeing a group of individuals happily protesting the ongoing murder of Palestinians in Israeli-occupied Gaza on or about October 11, 2024.”
Rivera ( pictured ) allegedly “participated in the protest because it was peaceful and taking place in a public place” afterward.
The Maroon notes that Rivera kicked a Chicago PD agent “in the rear of the leg” during the UChicago United for Palestine opposition.
Prior to that, the student newspaper reported that the officer claimed Rivera had even” shoved” and” stretched his with an open side to the left side of the face.”
According to , Campus Reform, the UChicago United for Palestine show had “blocked access to the school, defaced a monument on campus, and damaged authorities cars”.
The activist group attributed the blame to law enforcement, calling school officers” the school’s agents of brutality,” and citing the “dramatic escalation of police violence” as the source of the group’s protests.

According to the student housing agreement between the University of Chicago, the State of Illinois’s rules are” may be governed by and construed in accordance with them, without regard to its choice of law rules.” However, the Chicago Residential Landlord and Tenant Ordinance, which Rivera cites in his complaint, “provides several exemptions”.
” Student housing accommodations wherein the student and an institution of higher learning enter into a housing agreement or housing contract” is one of them. UChicago Law School professor Jeff Leslie said it’s “pretty clear” the university’s dorms “are exempt” from the tenant ordinance.
Rivera claims he was “made homeless” and” suffered from hunger and homelessness for months”.
Rivera is seeking” not less than$ 50, 000 per Plaintiff, plus costs, attorney fees, and whatever additional relief th]e ] Court deems appropriate”, according to the suit. ( Note: Since Rivera is the only plaintiff in the suit, it appears” Plaintiff” should be” Defendant” in the quoted segment. )
