    Trump’s education executive order faces congressional and legal hurdles

    The President’s executive order to begin shutting down the Department of Education is all but guaranteed to encounter many legal issues after numerous critics have criticized the action as illegal.

    Legally, the only person authorized by Congress is overthrow the Education Department. If the leader receives the essential seats, it is not clear.

    However, according to Trump’s order, Linda McMahon, the minister of education, must begin the process of shutting it down, despite previous attempts to drastically reduce the labor and greatly restrict its Office for Civil Rights.

    In his response to Trump’s order on Thursday, House Minority Leader Hakeem Jeffries (D-NY ) as well as several unions threatened future legal action.

    The Department of Education was established by Congress, and only an act of Congress you end it. In a statement, he said,” We will stop this evil Republican scheme in the House of Representatives and in the Courts.”

    In his remarks in the East Room, Trump made hints about the difficulties he might have in convincing the GOP-controlled Congress to abandon the office.

    Trump said,” It sounds weird doesn’t it, Department of Education we’re going to reduce it, and everyone knows it’s straight, and the Democrats know it’s right,” and that the office will” we’re going to reduce it.” And I hope they’re going to cast ballots for it because it might appear before them in the end.

    Rep. Bobby Scott (D-VA ), a member of the House Committee on Education and the Workforce, quickly claimed in a statement that the Courts will hear arguments against Trump’s decision to “dismantle the Department of Education and return education to the states.”

    Liberals are hoping that the Supreme Court will uphold the ruling, related to how a federal judge ordered the Department of Government Performance, led by Tesla’s CEO, to prevent any additional funding for the United States Agency for International Development.

    Theodore Chuang, a prosecutor in the United States, declared on Tuesday that DOGE’s unilateral shut down of USAID was good in violation of the constitution.

    Trump claimed that” Pell Grants, Title One cash, resources for children with disabilities and unique needs” would be preserved in his attempt in an effort to prevent potential legal harm.

    Republicans defended Trump’s defense of the department’s decision to retain its most considerable portion following its filing.

    According to the president, he claimed that the Pell Grant would remain as it has in the past, perhaps through a different-named organization, but he said nothing about ending or reducing Pell Grants. Greg Abbott (R-TX ) stated.

    ” You can tell by what the president said during his remarks as well as by what his business has released. They” really are dedicated to ] making sure that all the grant programs that are currently in place will continue to function flawlessly,” he continued.

    Sen. Bill Cassidy (R-LA ), the chairman of the Senate Health, Education, Labor, and Pensions Committee, praised Trump’s executive order in a statement and promised to work with Congress to dismantle the agency.

    According to President Trump,” I agree that the Department of Education has failed to fulfill its goal,” Cassidy said. I will help the President’s objectives by introducing legislation to accomplish this as soon as possible because the Department can only be shut down with legislative approval.

    In the wake of former President Jimmy Carter establishing the ministry in 1979, conservatives have long pushed for the federal government to lose command of the public education system to specific claims.
