A US national judge criticized the Trump administration’s decision to deport suspected Cuban crew members on Monday, claiming that” Nazis received better care” from the US during World War II.
The 1798 Alien Enemies Act ( AEA ), a unique act of wartime legislation, was used by President Donald Trump to transport two aircraft containing Venezuelan migrants to an El Salvador prison on March 15.
The Trump presidency is prohibited from conducting further imprisonment planes under the AEA by James Boasberg, chief prosecutor of the US District Court in Washington. A three-judge US Court of Appeals panel on Monday held oral arguments in response to the justice department’s request to remove the attempt.
Attorney for the Justice Department Drew Ensign claimed that the judge’s ruling severely impacted the senior branch’s authority and restricted the president’s authority to oversee foreign affairs and war.
Judge Patricia Millett expressed suspicion, noting that the lower court judge only questioned Trump’s political authority and the lack of specific hearings for deportees.
Numerous deported Venezuelans ‘ legal representatives claimed that their clients were targeted primarily because of their tattoos and were not Tren de Aragua ( TdA ) gang members.
Millett, an Obama appointment, said,” Nazis got better treatment under the Alien Enemies Act.” Before persons were removed, they had receiving boards.
She claimed that the passengers on those aircrafts on that Saturday had no way to challenge their treatment under the AEA. ” You could have picked me up on Saturday, thrown me on a plane, and given me no opportunity to rally,” he said.
Judge Justin Walker, who was appointed by Trump, made up his mind that he needed courtroom sessions while expressing his concern over criminal meddling with the administration’s authority.
The Trump administration’s use of the AEA to avoid immigration proceedings was disclosed by ACLU attorney Lee Gelernt to the appeals board.
