On April 3, the Department of Education informed every school district in the nation that they had ten days to officially announce that they had ended all diversity, equity, and inclusion ( DEI ) initiatives.

Minnesota and New York were two of the state that refused to follow the order. And then, California and Colorado have emerged as the nation’s most recent educational institutions to disobey the law.
For those state, there are tens of billions of dollars in federal money at stake. Los Angeles Unified School District receives$ 1.26 billion annually, while California receives$ 16.3 billion on its own.
The Education Department instructed all K-12 school districts and higher education institutions to end racial considerations in “admissions, hiring, development, payment, financial aid, scholarships, prizes, operational support, control, cover, graduation ceremonies, and all other aspects of scholar, educational, and campus life,” in a letter sent to them on February 14. The text was based on Donald Trump’s executive order implementing La programs in schools on January 29.
The learning department has given states until April 24 to obtain certifications, confirming that all La programs in the government’s K-12 classrooms have been ended.
Evidently, the Supreme Court will examine the accuracy of the professional purchase. In the interim, states will have to go without receiving federal money unless a federal judge returns funding while the situation is rifling through the courts.
The California Department of Education, or CDE, defended the propriety of La work in a text to school district superintendents on Friday.
Everything in state or federal law, according to Chief Deputy Supt., outlaws the large concepts of “diversity,” capital, and participation. In the email to charter schools, state education offices, and school districts, David Schapira.
CDE stated that the national request was vague and likewise sent a notice to the U.S. Department of Education about the decision not to cooperate.
Although the demand for certification mentions “certain DEI practices” or “illegal DEI,” it is unclear what specific programs or activities the federal agency [aims to control with this certification. It doesn’t establish” like,” it says.

Susana Córdova, the state’s education commissioner, stated at a conference of the state education table that she would not need adult school districts to do so and that she would never sign the certification letter.
Cordova said,” Honestly, I would get uneasy signing a certification that binds us to national guidance that doesn’t have the force of law.”  ,
She made an attempt to resolve the issue by claiming that the Trump administration omitted rules established by the Paperwork Reduction Act ( PRA ), a 1980 law that establishes rules for collecting information from the general public.
” It would be immoral to stifle federal funding because someone refuses to sign a document that we are not legally obligated to hint,” she said.
Although it was a good idea, the Department of Education’s letter and text did not follow the PRA’s administrative action rules.
On Wednesday, the State Board of Education met in an executive program that was kept closed to the general public to examine a constitutional letter regarding how the Colorado Department of Education intended to answer to the letter from April 3.
However, Republican members of the board, particularly Steve Durham, who represents the 5th Congressional District, pushed for the board to hold a public discussion about the agency’s response.
” The real reason, I think, is political rather than legal,” Durham said at the Thursday public meeting. There is plenty of evidence of DEI being misuse, but there can be significant debate or disagreement, I suppose.

Indeed, Democrats ‘ votes are being stifled by the political calculus that ending DEI would result in lessening support for it.  ,
Trump’s executive order has a uncertain future in the courts, where several Supreme Court decisions have confirmed DEI programs ‘ legality.
