    Since colonial times, Harvard hasn’t benefited from” an environment of philosophical investigation, demanding conversation, and common value.” But that is beyond the scope. The Obama administration tried to implement its changes to the sexual misconduct policies in all public schools that received federal funding in the same manner. By requiring those who are defending themselves against sexual misconduct charges to prove their innocence, those changes turned the phrase “innocent until proven guilty” in its favor. According to Reason’s Robby Soave, “[T]hese new policies also harmed free speech and academic freedom, as several professors who spoke out against the policies were later accused of violating them.”

    This was Obama’s view of Title IX, the federal statute that outlaws sex discrimination in education: His federal bureaucrats created such a mess that campus administrators felt compelled to investigate professors for criticizing the Education Department.

    Harvard’s law faculty vehemently opposed the policies adopted during the Obama administration. 28 Harvard law professors signed an open letter in October 2014, calling on the university to fight tyranny through Title IX and denounce the federal government’s meddling.

    The professors wrote that the university’s sexual harassment policy “devives significantly from these legal principles, jettisoning balance and fairness in the whirlwind of a desire to appease some federal administrative officials.” We are aware that significant sums of federal funding may end up in jeopardy. However, Harvard University and any other academic institution in the nation are positioned to stand up for principle in the face of funding threats.

    The letter was dated October 14, 2014.

    Harvard had no trouble bowing to the Obama administration at the time. The majority of schools gladly altered their procedures and curricula to fit the new Title IX policy.

    However, Elizabeth Bartholet, a seasoned Harvard Law professor who teaches civil rights and family law, called the federal government’s sexual misconduct campaign against colleges “madness.”

    She told The Wall Street Journal at the time,” I believe history will show that the federal government’s position is incorrect, that our society will look back on this time as a moment of madness, and that Harvard University will be deeply shamed for its role in simply caving to the government’s position.”

    Shame? Harvard is unsure of the word’s meaning.
