Howe explained on Tuesday as oral arguments before the Supreme Court began:
A group of Muslim, Catholic, and Russian Orthodox parents filed a lawsuit in federal court after the state announced in 2023 that it would not let kids to choose to have their children be exonerated from the storybook training. They claimed that the rejection to grant them the right to choose whether to opt out of their children violated their constitutional right to freely practice their religion, especially their right to control when and how their children are taught about gender and sexuality according to their beliefs.

The school district argued that the obvious material was simply too difficult for parents to opt out of, and instead of removing the highly contentious books, the district advised kids to” suck it up.” Several of them filed a lawsuit, citing Wisconsin v. Yoder as well.  ,
NPR’s Nina Totenberg reported that the school district did say that” taking children out of a lesson when a , one story book featuring same-sex parents or gay and lesbian kids had come up at any time is a logistical nightmare.” Where should the opt-out children be placed and how much should they stay there logistically?
