    Trump interview cited as evidence by Abrego Garcia lawyers seeking migrant’s return to US

    The current public remarks from President Donald Trump are used by Kilmar Abrego Garcia’s professionals as evidence that the management has the authority to bring their client from El Salvador but is choosing not to.

    The legal team cited Trump’s response in an ABC News interview in late April, in which he acknowledged he” could” call Salvadoran President Nayib Bukele to secure Abrego Garcia’s return, in a court filing this week. Trump defended the deportation of Abrego Garcia, saying,” If] Bukele were the gentleman that you say he is, I would do that. Abrego Garcia, a reported MS-13 group representative and illegal immigrant, was deported to El Salvador by mistake, according to the Trump administration. Times prior, a prosecutor had ordered Abrego Garcia to be deported from his native country.

    The government’s comments contradict the president’s court argument that keeping more details about the case is justified by national security concerns, according to Garcia’s attorneys in new filings. The attorneys told District Judge Paula Xinis in their registration that “official statements by the Government consistently confirm that producing this information may not threaten national protection” in parliamentary evidence, broadcast interviews, and social media.

    The Justice Department moved to cover its court-ordered luxury log the day before the meeting reference, citing “ongoing political conversations” with El Salvador. The administration’s policies on state techniques and professional privilege are detailed in the logs. DOJ officials claimed that making those details open “would possible harm” U.S. foreign relations and that the information is backed by a stipulated confidentiality order.

    According to threats from Barrio 18, a rival gang to MS-13, Abrego Garcia, who entered the United States illegally in 2011 was given legal defense from imprisonment in El Salvador in 2019. However, the Trump administration admitted in March that Abrego Garcia was falsely a member of a group of migrants who had been deported to the CECOT jail in El Salvador. Since then, he has been relocated to a service with lower security.

    The events have since debated whether the government should take immediate action to help Abrego Garcia return to the country or whether the attempt simply required the U.S. state to be willing to accept him if El Salvador volunteer to do so. Last month, the prosecutor accused the administration of “willful and bad-faith refusing” to follow the discovery purchases.

    In court papers, the DOJ asserted that it has already provided “robust” responses and that further information may not help the situation. However, the legal team for Abrego Garcia claims that the confidentiality accusations are being used to hide responsibilities. The purpose of the state secrets opportunity is not to conceal political errors or misconduct, they wrote in a filing on Monday.

    Attorney General Pam Bondi, Secretary of State Marco Rubio, and Homeland Security Secretary Kristi Noem’s public remarks against Abrego Garcia’s returning have also been cited in court as more evidence that privacy statements are incompatible with the government’s personal conduct.

    A hearing on the deportation issue will be held on Friday afternoon in Greenbelt, Maryland.
