'No one is above law': Democratic Rep. LaMonica McIver charged with assault after ICE facility confrontation
On Friday, May 9, 2025, in Newark, New Jersey, Congresswoman Rep. LaMonica McIver demands the release of Newark Mayor Ras Baraka after his incarceration while protesting outside an ICE incarceration facility.

Democrat Rep. LaMonica McIver is facing assault charges after reportedly confronting law enforcement officers outside a Newark immigration detention facility, according to the acting New Jersey US attorney on Monday. Alina Habba, the acting US attorney for New Jersey, made the criminal allegations public by announcing the charges on social media:” Today my office has charged Congresswoman McIver with violating Title 18, United States Code, Section 111( a ) ( 1 ) for assaulting, impeding, and interfering with law enforcement.” On May 9, the incident took place at the Delaney Hall Detention Centre, where many Democratic lawmakers were manifest. Political Newark Mayor Ras Baraka was detained for allegedly trespassing at the hospital, which has deals with Immigration and Customs Enforcement, during the occasion. Habha explained that she made an effort to resolve the conflict without filing claims. ” I have tried my hardest to resolve these issues without bringing legal charges, and I have given Representative McIver every chance to resolve them,” she continued, regretting that she had refrained from doing so. The US lawyer continued,” No one is above the law, whether officials or not. ” Irrespective of who you are, it is the work of this office to defend justice equitably.” The homeland security department made a film that spanned almost two days that shows McIver standing by the agency’s part of a chain link fence prior to the president’s arrest. She is spotted yelling” encircle the mayor” while passing through the gate and joining other people in doing so. Her arms come into contact with an officer wearing an olive green uniform and a face covering, which read” Authorities” in the crowded field.

McIver claims that ICE agents created an “unnecessary and uncomfortable confrontation” and that her arrest is “purely social.”

According to McIver, who claimed that she and her colleagues were able to assess the treatment of ICE prisoners at Delaney Hall, it was the ICE who” created an unnecessary and uncomfortable clash” when they decided to arrest Mayor Baraka. I visited Delaney Hall in my neighborhood earlier this month with my coworkers to check how they were treated ICE prisoners. Our attend should have been brief and calm because we were carrying out our lawful oversight duties, as members of Congress have done many times earlier. When they decided to arrest Mayor Baraka, ICE agents rather chose to have an unnecessary and uncomfortable clash,” she said. The costs against me are simply political; they defame and defame my actions, and they are intended to demonize and deter congressional oversight. This administration did not prevent me from standing up for what is right and working for the people in our area. I’m appreciative of the support I’ve received, and I’m eager to see the fact plainly presented in court,” she continued. However, Paul Fishman, the former US attorney for New Jersey and McIver’s counsel, denounced the charges against her as being” perfectly inappropriate.” He made it clear that she was there to watch ICE’s detainees as part of her parliamentary jobs. According to Fishman, ICE agents altered a possible tranquil setting into chaos. He claimed that this trial is making an effort to deflect ICE’s actions against Congresswoman McIver, stressing that scientific evidence, certainly media coverage, would be the difference between the two parties in court.
