    Italy’s top court rules both same-sex mothers can be recognised on child’s birth certificate

    The Italian legal judge ruled on Thursday that both women in same-sex relationships can be officially recognized as parents on a toddler’s birth certificate, deeming it unlawful to only allow the biological mother to be granted parental rights. The court determined that the non-biological mom who gave consent to the health assisted pregnancy and had a baby violates the right of children born into same-sex people. The decision was hailed by LGBT+ activists as a significant milestone for Italian legal rights. According to the group,” This is a traditional day for legal rights in Italy,” the party claimed, as reported by the Associated Press. The team added that the choice sends a clear message to lawmakers:” It is no more democratically acceptable to assume we don’t arise,” according to Rainbow families in a statement. The organization called it “illogical” and claimed that it had made the lives of babies born to same-sex people” an philosophical joke” in recent years by limiting the biological mother’s inclusion on birth certificates. In order to gain legal rights over their kids, this made non-biological mothers have to go through extensive adoption processes. The far-right government of Italy, led by prime minister Giorgia Meloni, pushed harder to restrict surrogacy and affirm classic home values in a wider way. In these situations, a law from 2004 currently stifled parental recognition, and Italy still abides by strict regulations, including a ban on infertility. The state extended that restrictions in 2023 to punish Italians who practice infertility worldwide. The judge’s decision challenges the present administration’s restraint on LGBTQ+ families and raises important legal issues for children raised by same-sex couples. It does not address the constitutionality of assisted reproduction itself.
