Professor called ‘racist’ for saying ‘mob’ can sue trustees: judge rules

Professor Jack Lipton of Michigan State University claims directors ran a campaign against him in a bid to get him to attend school.

A federal judge recently upheld a lawsuit brought by a professor at Michigan State University against two directors for their involvement in a slew of qualified campaigns against him.

Judge Hala Jarbou dismissed Professor Jack Lipton’s complaint against the board of trustees, with the exception of her complaint against Trustee Rema Vassar acting in her own and official power. According to the May 28 decision, his legal state against Trustee Dennis Denno continues to exist.

Concern began in October 2023, as previously reported by The College Fix, while Lipton ( pictured, left ) served as the chair of the faculty senate. He criticized Vassar ( pictured, right ), the then chair of the board, in a letter he wrote on behalf of the faculty senate for his alleged unethical behavior.

According to the complaint, Vassar even accepted donations from a university benefactor, including taking private flight trips. Additionally, she made an appearance in an advertisement supporting a former treasurer’s private wealth management company.

Due to allegations against her, Vassar organized her college sisters to attend the meeting. According to Lipton’s complaint, her followers “jeered” at anyone who attacked her during the meeting.

Lipton told The Detroit News the following moment:” She elected to let the crowd rule the room and the conflict brought on by her followers could have been stopped by a single speech from Chair Vassar. Denno called this speech racist. According to The State News, Denno and an unnamed student arranged to speak with a reporter and declare that” Lipton = Racist”

Denno and Vassar continued to pin Lipton, as summarized in Judge Jarbou’s decision.

Lipton alleges facts that show the racial actions Vassar and Denno took while serving as BOT members because they were inspired by Lipton’s conversation and may deter First Amendment activity of a man of normal firmness. The speech that Vassar and Denno may employ to attack Lipton was created by Vassar and Denno. They compelled pupils to lodge grievances. And they coordinated with students to boost criticism of Lipton for his protected speech while carrying out their official duties at the BOT meeting on December 15, 2023. Public officials can’t protect themselves from violating the First Amendment’s safeguards by just allowing others to engage in hostile behavior, especially when they use their open positions to do so.

According to Professor Lipton, an executive firm associate warned him that the controversy had upset him as he looked for work elsewhere. On this base, the judge determined Lipton had a situation.

But, Judge Jarbou determined that Lipton had no legal recourse against the other directors because they had not specifically acted against him. He claimed that because they may have intervened to stop Denno and Vassar, they were at fault. According to the decision, the panel did criticize Vassar and Denno.

The State News reported that Democrat governor Gretchen Whitmer would not be removing Denno and Vassar from the table around the same day as the decision. Yet though” an outside investigation determined that the trustees had interfered with board rules and code of ethics by interfering with university politics and using student groups to organize attacks against coworkers,” this decision was made.

Further: Illinois could soon be the state that mandates campus-level abortions.
