After an El Paso County prosecutor determined that he had no authority over the case, a judge in El Paso, Texas (KTSM) tossed around 200 migratory misdemeanor violence cases and discharged the defendants.  ,
The 214 cases are in relation to the March 21 borders “riot” that happened at Gate 36.  ,
El Paso County’s public defender Kelli Childress argued at a reading about the state’s failure to transfer control, and County Court of Law Judge Ruben Morales had no basis to hear the instances.  ,
Childress claimed that the district attorney’s office moved more than 200 cases to district judge after being indicted, but were later returned to the state. A shift order is required in order to move jurisdiction from one court to another, something that was lacking in the state.  ,
The state argued that Judge Morale’s judge oversaw criminal scenarios, and he did have control.  ,
Finally, Morales sided with the common defence and said his “hands are tied” without the order move.  ,
Childress claimed that she was unsure as to why the state decided to prosecute someone, but that effort only serves to waste resources.  ,
” My company alone has 1, 600 cases awaiting testing by the DA’s office, but 800 of those have been waiting more than six weeks. 400 of those have been waiting more than a year and these circumstances, apparently, 18 days after they’re dismissed for no possible cause, those are able to be brought to a grand jury. It’s very frustrating” , , said Childress.  ,
