A New York appeals court on Tuesday rejected previous president Donald Trump’s request to issue New York Judge Juan Merchan’s gag order. The appeals prosecutor’s decision comes as the second week of Trump’s quiet- money trial continues.
Announcing its decision to reject Trump’s movement, the New York appeals court wrote,” We find that Justice Merchan effectively weighed plaintiff’s First Amendment Rights against the judge’s historical commitment to ensuring the fair administration of justice in criminal cases, and the right of people related or tangentially related to the legal proceedings from being completely from risks, intimidation, harassment, and harm”.
The former president has already been fined by Merchan ten times by him as a result of the hush-money test, in which case Trump is prohibited from speaking or releasing claims about jurors, judge personnel, attorneys, and Merchan’s family, according to The Daily Wire.
While Trump and his legal team had argued that the joke get violates his First Amendment right to free speech, Merchan has argued that the former mayor’s claims must be kept under a lid to stop any testimony from being intimidated throughout the test.
In response to the controversy surrounding the gag order, the appeals court argued that Justice Merchan had established that the testimony of the petitioner and other possible testimony in this case was seriously hampered by the petitioner’s statements.

Merchan’s joke get pertains to Democrat Manhattan District Attorney Alvin Bragg’s circumstance against Trump, which claims that Trump authorized hush- cash payments to Stormy Daniels, an adult film star, during the 2016 presidential campaign. According to The Daily Wire, Merchan threatened to” consider a jail sentence” if the former president continues to break the gag order last week.

Merchan added that the “magnitude” of the decision to potentially sentence Trump to prison is” not lost” on him. However, he argued that the former president’s” continued willful violation” of the gag order represents a “direct attack” and would” not be allowed to continue”.
Following Merchan’s threat to consider incarcerating him, Trump told reporters,” I have to watch every word I tell you people. You ask me a question, a simple question, I’d like to give it, but I ca n’t talk about it because this judge is giving me a gag order and said you’ll go to jail if you violate it”.
Trump added,” And frankly, you know what, our Constitution is much more important than jail. It’s not even close. I’ll do that sacrifice any day”.
