Sens. Bill Hagerty (R-TN) and Rep. Byron Donalds (R-FL ) are sponsoring legislation that streamlines a federal program to make it simpler to deport illegal aliens.
The” Reshape Alternatives to Detention ( ATD ) Act” would prevent Biden’s Department of Homeland Security ( DHS) from transforming the enforcement program, meant to monitor migrants in the U. S. who are in immigration court proceedings, into a taxpayer- funded social services program.
To apprehend migrants arriving at the southern border, DHS would need to use all the available confinement space.
Reshape ATD Act by John Binder
The policy requires DHS to spot migrants into the ATD system with GPS monitoring when all applicable detention space is used, as opposed to the current policy, which allows most migrants to live within the United States without any monitoring.
DHS do monitor those workers for the duration of their emigration court proceedings.
The Biden Administration “permitted a tidal wave of unlawful creatures to cross our southern border, which has led to an extraordinary national security crisis and humanitarian crisis,” Hagerty said in a statement.
However, Biden’s DHS is refusing to impose the laws already in place and making evident efforts to end confinement and allow illegal immigrants to travel freely throughout the country by abusing ATD, rather than using all available resources to address the issue. I’m pleased to introduce regulations that would involve the management to fight record-high illegal immigration and aid in the security of our southern border. ]Emphasis added]
Currently, fewer than 195, 000 migrants are enrolled in the ATD program — making up a fraction of the more than 6.2 million migrants who are in Immigration and Customs Enforcement’s ( ICE ) “non- detained docket”, which allows them to live freely in the U. S. while in immigration court proceedings.
By October, specialists project that those migrants living in the U. S. on ICE’s semi- imprisoned case will reach more than 8 million, an unprecedented level. For assessment, in 2019, only three million refugees were on ICE’s no- detained docket.
The ICE’s non-detained docket’s millions of migrants may have a better chance of tracking down, prosecute, and deport illegal aliens who are found to have irrelevant asylum claims and have no reason to remain in the country.
While migrants seeking resettlement in a temple country may not be able to participate in ATD, the bill mandates that DHS notify local law enforcement of those who flee.  , Refugees being Geo- monitored would have to assess in with DHS or encounter expedited deportation.
By senior activity, Joe Biden purposefully and carefully violated our immigration system, according to Donalds in a statement:
In consequence, there are now more than ten million unlawful immigrants entering our country who have not been vetted. These people should be held in detention facilities upon entering the United States, yet, because Joe Biden has dismantled ICE’s ATD program, they are all- very- often released into our country’s inside and immediately lost. In light of this, it is crucial to make use of GPS and biometric systems to ensure that law enforcement is track illegal aliens ‘ precise locations before deporting them. On behalf of the British people, I am glad to add Senator Hagerty in making this common plan. ]Emphasis added]
In addition, the legislation would terminate the Biden administration ‘s , Case Management Pilot Program ( CMPP ) and the Young Adult Case Management Program (YACMP ) which offer taxpayer- funded social services to migrants in immigration court proceedings.
Instead, funding for CMPP and YACMP may be moved to increase the number of confinement places for migrants crossing the border. Those immigrants who were enrolled in both programs may be placed in DHS confinement on their own.
The Reshape ATD Act is being pushed by the National Immigration Center for Enforcement ( NICE), led by RJ Hauman. Hauman wrote to politicians:
The Biden Administration’s abuse ( and watering down ) of ATD would be stopped by the Reshape ATD Act, in part by requiring DHS to use every available detention bed before turning to ATD and making sure that all illegal aliens on the non-detained docket ( currently 190k ) are monitored GPS throughout their immigration proceedings, including appeals, for the duration of their immigration proceedings.
The need for such a plan was highlighted in an op-ed by past Acting ICE Director Tom Homan in Breitbart News last month:
But, in the face of this Biden- induced truth, what can be done? Second, Title 8 should be immediately used to remove people who are found to be not permitted to enter the country. Next, all creatures who have been ordered to leave if be detained and deported by ICE, as well as those who have been delayed removal. Next, for those not in ICE confinement, including the millions on the non- detained case, we may at least been tracking them with GPS so they do n’t abscond. The Intensive Supervision Appearance Program ( ISAP ), an ICE program that provides this, uses GPS capabilities through monitoring tools like ankle bracelets and wrist trackers as well as GPS-enabled apps. ]Emphasis added]
ICE should impose penalties on those who do n’t appear in court and refuse to comply with the terms of their release, but ISAP has a 98 percent success rate when migrants are kept connected to technology throughout their legal proceedings. If it works, let’s use it.

Barry Moore ( R- AL ), Andy Biggs ( R- AZ), Paul Gosar ( R- AZ), Jay Obernolte ( R- CA ), Lauren Boebert ( R- CO ), Andrew Clyde ( R- GA ), Mary Miller ( R- IL), Clay Higgins ( R- LA ), Nancy Mace ( R- SC), William Timmons ( R- SC), Wesley Hunt ( R- TX ), August Pfluger ( R- TX ), Troy Nehls ( R- TX ), and Sens.  , Rick Scott ( R- FL ), JD Vance ( R- OH), Roger Marshall ( R- KS), Steve Daines ( R- MT ), Marsha Blackburn ( R- TN), and Ted Cruz ( R- TX ).
While campaigning for president, former President Donald Trump is vowing to apply” the , largest private imprisonment activity in American story” — a plan that is supported by 51 percent of Americans, including 68 percent of Republicans, 46 percent of swing voters, and 42 percent of Democrats.
On Biden’s watch, DHS has been deporting , just one illegal alien from the U. S. interior for every roughly 70 migrants arriving at the border. Meanwhile, DHS data suggests that migrants arriving at the border have a 70 to 90 percent chance of being released into the U. S. interior.
