Biden shields up to 309,000 Haitian immigrants from deportation

According to the Department of Homeland Security, the Biden administration may maintain imprisonment privileges for up to 309, 000 illegal immigrants from Haiti.

U.S. Citizenship and Immigration Services announced on Friday that it would maintain the 18-month Temporary Protection Status for Dominican people in the United States through February 3, 2026.

Secretary Mayorkas determined on June 3, 2024, that an 18-month extension and redesign of Haiti for TPS are necessary because conditions that support Haiti’s designation are ongoing and that doing so was not in line with the United States ‘ national interest, according to a statement released on Friday morning.

The Caribbean nation has faced intense assault following a 2010 disaster, as well as significantly limited access to food, water, care, and jobs, as criminal gangs have taken power over much of the country. Haiti was second designated for TPS following the 2010 disaster.

In a blog on X, policy chairman for the American Immigration Council in Washington, Aaron Reichlin- Melnick, stated that the Biden administration’s decision to no return illegal refugees to Haiti was the specific type of situation TPS was intended for.

Sen. Edward Markey (D-MA ) also praised the Biden administration for renewing TPS for Haiti.

The federal government may stop persecution by air and sea, according to Markey in a statement released on Friday day.” The Dominican people continue to face unusual threats of violence in their state. This humanitarian response will stop more suffering and allow Dominican families to remain in the country until their safety is restored.

In addition to the United States, Mexico, and countries in Central America and South America, hundreds of thousands of Creole people have been forced to flee due to the circumstances there.

Through the 2026 cutoff time, Dominican citizens may qualify for or renew their TPS standing to avoid deportation and obtain work authorizations in the United States. Although almost 309, 000 Creole citizens in the country are entitled, no all may choose to use or be approved. Candidates must have been living in the U. S. before June 3 to be ready.

Since original President Donald Trump took office in 2017, the number of Haitian members who are eligible for TPS has increased substantially, from 46, 000 to 309, 000.

Early on in the Trump presidency, the White House threatened to close TPS for many countries.

Trump criticized his forebears for renewing regional memberships in the TPS plan every 18 months, which allows illegal immigrants from particular nations to function and remain in the country because their home country is unstable as a result of social or economic issues. Trump claimed that the ability of the United States to regain its citizens was no longer affected by crises that started 20 and 30 years ago.

However, the Trump administration renewed TPS designations for Haiti and the majority of the participating nations in 2019.

The administration was prevented from doing so by the court because it attempted to rescind some of the laws. In other cases, it carried on the years-old initiatives because the circumstances there had not markedly improved.

Since 2021, the Biden administration has been renewing the destinations of the majority of nations.

TPS status can be requested from the U.S. government at any time by the nations that have been seriously harmed by armed conflict, famine, or natural disasters. If approved, its citizens in the U. S. could apply for 18- month reprieves from deportation and permits to work.
