The state’s highest court reiterated its position that the state constitution protects abortion access on Friday by upholding state laws that restrict abortion providers more completely than other medical professionals and a ban on a typical second-trimester procedure.
In overturning the prohibition on a particular kind of constriction and departure, also known as D&, E, Justice Eric Rosen wrote for the majority in support of our finish that part 1 of the Kansas Constitution Bill of Rights protects a basic right to personal freedom, which includes a pregnant woman’s right to terminate a pregnancy.
The board determined that the position had violated the state’s legal obligation by severing the law’s provisions from the clinic regulations and supporting its legitimate interests in protecting and regulating the medical profession as it relates to maternal health.
The state’s Republican-controlled Law faces stiffer governing of abortion than GOP lawmakers believed, according to the Kansas Supreme Court’s 5- 1 rulings in two distinct cases, which suggests another restrictions may be in place. Lower state authorities have filed lawsuits challenging laws governing the use of teleconferences to meet with clients, the requirements for what physicians must disclose to patients before an abortion, and the need that patients wait 24 hours after receiving information about a method to cancel their pregnancies.
Justice K. J. Wall did not participate in either decision on Friday, only Justice Caleb Stegall being the only one who dissented.
Stegall said in his dissention of the center regulations case that the majority’s actions did” for years to come” harm the court’s legitimacy. He claimed that the state constitution’s claim that a right to bodily independence is protected by the state constitution could have an impact on a “massive swath” of other health and safety laws, including licensing requirements for salons.

Stegall, who was appointed by conventional Republican Gov Sam Brownback, is commonly regarded as the court’s most liberal part.
Kansas ‘ top prosecutor declared in a 2019 determination that abortion access is a matter of physical freedom and a “fundamental” appropriate under the state law. Voters in August 2022 also vehemently opposed a proposed amendment that would have explicitly stated that abortion was not a fundamental right and allowed state legislators to significantly restrict or outlaw it.
The justices had urged the state’s attorneys to reverse the 2019 decision and uphold the two laws, which had not yet been enforced because of the legal battles over them. The state’s solicitor general, appointed by Republican Attorney General Kris Kobach, had argued the 2022 vote did n’t matter in determining whether the laws could stand.
The court sided with the opposition, earning a significant legal victory for pro-choice supporters.
Since the U.S. Supreme Court issued its Dobbs decision in June 2022, which allowed states to completely ban abortion, Kansas has become an outlier among states with Republican-controlled legislatures. In response to that, more patients are coming from states with stricter laws, particularly Texas and Oklahoma. The Guttmacher Institute, which supports abortion rights, projected last month that about 20, 000 abortions were performed in Kansas in 2023 or 152 % more than in 2020.
Kansas does n’t impose most abortions until the 22nd week of pregnancy, but it does require that minors obtain the parents ‘ or a guardian’s written consent. Other requirements, including the 24- hour waiting period and what a provider must tell patients, have been put on hold. A lower court is considering a provider’s challenge to them.
Before the August 2022 vote, abortion opponents argued that long-standing restrictions imposed by previous GOP governors would be endangering if the state constitution were not changed. Sam Brownback, a former Republican governor, implemented a flurry of new restrictions in Kansas from 2011 to 2018.
In 2011, the health and safety regulations were passed specifically aimed at abortion providers. Supporters promised to safeguard women’s health, but there was no proof then that such rules in other states would result in better health outcomes. The real goal, according to the sellers, was to make them quit.
The first of its kind was the ban on a particular type of D&, E procedure carried out during the second trimester when it was passed in 2015.
According to state health department statistics, about 600 D&, E procedures were done in Kansas in 2022, accounting for 5 % of the state’s total abortions. About 88 % of the state’s abortions occurred in the first trimester. The state has not yet released 2023 statistics.
The Center for Reproductive Rights, an advocacy group for abortion rights, has claimed that the procedure ban would have made providers use alternative methods that are more expensive and riskier for the patient.
The lawsuit over the ban from 2015 was still in its early stages when the 2019 ruling was made. The justices continued to hold the case while sending it back to the trial court to review the ban. The law was declared invalid by a trial judge.
Three of the court’s seven justices joined the court since the 2019 decision. Democratic governor Laura Kelly, a vocal supporter of abortion rights, appointed all three of them, but one of the three removed himself from the cases.
