
Physical abuse allegations against a , Nellis Air Force Base , commander have been dropped in defense judge, but he could still be discharged from the military.
Police in 2022 , accused Lt. Col.  , Kevin DiFalco , of grooming a lady, raping her and committing lewd works in front of her. According to a police report from the Metropolitan Police Department’s arrest report, the woman claimed DiFalco had written documents asking that she should see her don bikinis and underwear. She claimed to have been raped by him many times, that she had an eating disorder, and that she had attempted to opioid as a result.
DiFalco could not be reached for comment Monday, but , recently told a defense information website , that he denied the allegations.
In the Las Vegas Justice Court, he was accused of indecency in front of a baby and child abuse or neglect, but the prosecution refuted the accusations in the October 2022 trial. The situation was “being turned over to the military judge,” according to a note on the docket sheet.
In the martial court-martial approach, DiFalco’s costs included sexual abuse, physical abuse of a baby, obstructing justice and obscene exposure, according to Maj.  , Lauren Ott, an , Air Force , director. The fees were referred to the court-martial on , Jan. 22, 2024, Ott said, and withdrawn and dismissed on , June 7.
The charges were dismissed without prejudice, which means” the , Air Force , retains the option to indict these costs at a later time”, Ott said.
Citing pending operational trials, Ott said she could not expound on why the costs were withdrawn.
An administrative , Board of Inquiry , hearing is scheduled for September and the table has the power to speak testimony, examine data and determine whether an agent may be discharged, Ott said.
In the meantime, Ott said, DiFalco is on active duty at Nellis as a special projects agent.
