Biden tightening asylum process as illegal immigration surges on Canadian border

As the number of illegal border crossing arrests rises to new highs, the Biden administration is moving quickly to process asylum claims along the U.S.-Canada borders.

According to a CBS News report released on Tuesday evening by the DHS, the Department of Homeland Security plans to speed up the asylum-seeking method for immigrants who are being detained by Border Patrol agents on the northern borders.

The move aims to expedite the detention of suspects and shorten the duration of their captivity, especially given that Border Patrol’s ability to apprehend suspects has increased over the past year and has had an impact on their ability to detain them.

According to statistics from U. S. Customs and Border Protection, the number of migrants detained by the Border Patrol across the U.S. Canada border has increased from less than 1, 000 in governmental 2021 to more than 16, 000 in governmental 2024. This does not include the final three months of the year. Traditional standards were in the middle of the 2021 and 2024 numbers.

The United States intends to change the way in which it implements the Safe Third Country Agreement from 2002 with Canada. The agreement, which was updated next year, allows either nation to return people who illegally enter to the other country on the grounds that both countries are sufficient for seeking prison, and that if one person has not sought shelter there, they may do so in the additional.

Immigration agents who were detained by Border Patrol on the northern frontier had until recently been given the right to postpone prison examinations with federal officers so they had time to gather evidence and supporting documents.

With instances for children who arrive without a parent or guardian and those who already have a family member in the United States, immigration will no longer be able to defer the prison screen.

The Department of Homeland Security ( DHS) is continuing to uphold our immigration laws and impose severe penalties on noncitizens who do not have a legal basis to remain in the country, according to a statement released following publication.

Second, workers will no longer have a 24-hour time to consult with a lawyer before an asylum testing, CBS reported. According to the DHS, workers in captivity will have at least four hours to seek legal counsel. Both adjustments may be implemented on Wednesday.

According to the DHS, “it was determined after thorough analysis how the Safe Third Country Agreement with Canada could streamline the process for determining a claim for hospital or other similar temporary shelter for noncitizens” without affecting noncitizens ‘ ability to have access to a comprehensive and sensible process for determining that state.
