    New Mexico judge to weigh whether ‘Rust’ armorer Hannah Gutierrez should be freed

    One month after&nbsp, dismissing Alec Baldwin’s involuntary manslaughter charges&nbsp, in the dangerous” Rust” shooting, a New Mexico prosecutor has indicated she will regard whether arms operator Hannah Gutierrez even should be set free — or given a fresh trial.

    After a two-week test, &nbsp, Gutierrez was convicted in March&nbsp, of involuntary manslaughter in the death of cinematographer Halyna Hutchins.

    Gutierrez acknowledged carrying the weapon that morning. In October 2021, Gutierrez’s accusation is that she brought the life guns with her to the” Iron” film set near Santa Fe, N. M., which she has persistently denied.

    Since Baldwin’s event collapsed in July, the trial has been in turmoil as a result of reports that a special prosecutor and Santa Fe County Sheriff’s deputies had withheld potential information from the actor-producer’s attorneys.

    The registration — which came on the second day of the director’s high-profile trial in Santa Fe — stunned the prosecutor and New Mexico’s legitimate area.

    For reportedly withholding possible information that could have been useful to Baldwin’s situation, New Mexico First Judicial District Judge Mary Marlowe Sommer was angry with representatives and the special counsel, Kari T. Morrissey.

    In March, a retired police officer from Arizona reported to deputies that shells might fit the fatal bullet from the” Metal” shooting, in which Hutchins was shot.

    However, as Baldwin’s team looked through the sheriff’s files and boxes of information as they deliberated for the actor’s test, deputies assigned the case of facts a different situation number than the one used for the” Rust” shooting proof.

    After the situation against Baldwin was dismissed, Gutierrez’s Albuquerque lawyer, Jason Bowles, filed a motion to obtain Gutierrez released from the New Mexico children’s prison, where she is already serving an 18-month word for the criminal conviction.

    Bowles argued in a movement that Morrissey, who was the special counsel for Gutierrez’s case, also withheld information in advance of the prosecution, including a recorded meeting with weapons company Seth Kenney, who was a major prosecution witness. Due to alleged” severe and ongoing discovery violations by the state,” Bowles demanded a new trial or dismissal of Gutierrez’s case.

    ” There can be no legitimate debate that the state violated Ms. Gutierrez’s due process rights”, Bowles wrote, asking the judge to “order a new trial or dismissal of the case for egregious prosecutorial misconduct. The Court should also order Ms. Gutierrez’s release”.

    A Sept. 27 hearing was scheduled for Marlowe Sommer on Tuesday to decide whether Gutierrez should be detained or given a new trial.

    Morrissey has opposed the request for a new trial and has refuted the misconduct allegations.

    She noted that Bowles was aware of the disputed evidence in the Baldwin case, which was contested by deputies in March.

    The former police officer, Troy Teske, who brought the bullets to New Mexico, is a close friend of Gutierrez’s father, Hollywood gun handler Thell Reed. Morrissey has said the bullets were not relevant because they were in Arizona, not New Mexico, at the time of the” Rust” shooting.

    Teske was in Santa Fe in March to be a defense witness. However, Bowles did not call Teske in to give testimony.
