She also was accused of disorderly conduct in a Capitol building, destruction of government property, and using a deadly or dangerous weapon, the “ice axe and battering ram” to break through a window and “breach the Capitol.” Powell claimed in a statement to Newsweek that she “used the axe and the cardboard battering ram to break a window so that some in the group near the tunnel could move to open spaces” and that she “used the bullhorn to flag a nearby safe haven that she saw on the other side of the glass she had shattered.”
After being thrown in the book by D.C. District Judge Royce Lamberth in October 2023, Powell is serving a nearly five-year prison sentence. Prior to that, Powell spent years awaiting trial and sentencing under strict house arrest.  ,

Powell “missed her daughter’s wedding. She missed the birth of her two grandchildren. If one of her children needed the mother’s assistance, she couldn’t even go to a doctor’s appointment, Hughes continued.  ,
Powell’s youngest child was just 7 when she was sent to prison.  ,
Although Powell did damage government property, Hughes claimed she had no prior criminal history and that she had not assaulted or hurt law enforcement during the riot. The mother of eight, however, received harsher treatment than many of the Black Lives Matter protesters who staged riots that burned down government buildings, damaged private property, and brutally assaulted police.  ,
