Under the 1798 Alien Enemies Act ( AEA ), a US supreme court on Monday lifted a lower court’s ruling that had halted the deportation of undocumented Venezuelan migrants.
In a small 5–4 decision, the justices approved deportations to continue, supporting the Trump administration’s plan to eliminate the migrants under a statement aimed at the Venezuelan group Tren de Aragua. The court even stated that those who have been deported under the AEA must have a good chance to bring a case in court.
In a post on his Truth Social, Trump praised the prosecutor’s decision, saying,” The supreme court has upheld the rule of law in our land by allowing a senator, whoever that may be, to secure our borders and protect our families and our land, itself. A fantastic time for American justice”!
Alien Enemies Act: What is it?
The Alien Enemies Act is a wartime law that gives the president the power to deport immigrants from countries considered enemies during a time of war.
Donald Trump claimed during his plan that the Act, which hasn’t been enforced since World War II, was intended to prosecute Asian Americans, was being used.
The law is intended to be applied when the United States and another country are at war or when a foreign country attacks or threatens to harm the United States.
The president has formally declare the event that led to the use of the Act in order to use it. The legislation is in effect until the senator repeals it.
The Trump administration argued that using the legislation, international drug cartel may be treated as an “invasion” or “predatory incursion” as a pretext for enacting the law.
