A Yonkers woman, 28, has filed a federal complaint against DNA Diagnostics Center and Winn Health Labs, alleging that a flawed paternity test caused her to kill her conception and unintentionally stop her wedding, only to discover months later that the test results were inaccurate.
The person, who requested anonymity, was quoted by The New York Post as saying,” My girl would have been born on April 17… These results were the reason why I made the decision to do what I did,” with tears in her eyes.
When the woman and her fiance recently broke up next summer due to the strain of fertility problems, the couple had been trying to conceive for some time. She claims that shelter was used during one experience with another man while she was there at the time. When she afterwards learned that she was female, she knew her fiance was the father.
But she secretly conducted a paternity check with her ex-partner to prevent potential doubts.
The lady turned to DNA Diagnostics Center, a company that claims to be a world leader in DNA tests after spending more than$ 1, 000 on two conclusive tests. She raised questions about competence and privacy at Winn Health Labs in the Bronx, a location that also serves as a beauty shop.
According to NBC News, her attorney Craig Phemister said,” You don’t want to request for a paternity test in front of people getting their hair done.
The results were returned on Halloween 2024, indicating a 99.99 % chance that the other man had been the father. She made the decision to end her pregnancy as the 24-week pregnancy cap in New York grew closer. She reportedly told NBC,” I decided to keep my marriage.” She continued,” I thought this was completely true.”
However, on Valentine’s Day, four months later, DNA Diagnostics received startling information that there had been an “IT problem,” and the person identified as the father had not been medically related to the unborn baby. A 0 % meet was discovered in a corrected report.
The psychological damage was already inevitable by that point. Soon after the correction was made public, her fiance, who was devastated by the first test results and her choice, broke up with her.
She said,” You took away the home I could have had.” She continued,” The reason I took action was because I backed these results.”
DNA Diagnostics claimed to maintain strict quality power despite declining to discuss how the problem occurred. The company stated in a statement that” we take immediate action to verify the results and notify customers of any problems.”
This is not the first moment the facility has been subject to scrutiny. Joel Santiago, a gentleman from Connecticut, was misinformed that he wasn’t the father of his daughter in 2018. This error was fixed 18 months afterwards.
He won a$ 2.5 million settlement with DNA Diagnostics after filing a successful lawsuit.
Phemister contends that there are far more repercussions than just one circumstance. He claimed that” the similar DNA laboratories are conducting tests that court systems have relied on.” Women’s lives are ruined if they make mistakes, according to Phemister, who continued,” If they don’t make them mistakes for months or years, then they never find them.”
The Yonkers person is currently receiving treatments, hoping her story will lead to accountability. How many people were there as a result? she enquired.
