Following a monument Supreme Court decision that defines “woman” in the Equality Act 2010 as purely a natural woman, a Twitter change between UK Labour MP Apsana Begum and YouTuber Mahyar Tousi has attracted the attention of the public.
Begum responded to the decision on X ( previously Twitter ), saying that “including the trans community is essential to ensuring that everyone in society is equal.” Now more than ever, we may offer them integrity and security in the wake of the growing attacks on transgender people, the decline of their human rights, and the recent court ruling.
In response, Tousi asked,” Would you send’trans women’ to the male or female area of a minaret, Apsana” —a response that sparked outcry and rekindled debate over gender identity, transgender rights, and gender identity in public places.
The online racial conflict occurred shortly after the UK Supreme Court made the unanimous decision that the Equality Act 2010’s definitions of “woman” and” sex” only apply to biological girls. According to Deputy President of the Supreme Court, Justice Patrick Hodge,” the unanimous decision of this jury is that the term “woman” and” sexual” in the Equality Act 2010 refer to biological females and biological intercourse.” We advise against viewing this ruling as a victory for one or more of our society’s minorities at the price of another. It is not.”
The decision is seen as a significant blow to transgender rights activists, particularly in terms of access to women-only places like sports facilities, hospital wards, and domestic violence shelters. According to legal experts, the decision may have an impact on upcoming legal disputes involving identical pay, sex-segregated places, and hiring diversity.
The court clarified that transgender people’s privileges fall under “gender reassignment,” not” sex,” despite the court’s confirmation that transgender people are still protected by the work. The group For Women Scotland ( FWS), which had brought the case, challenged a Scottish government directive that made it illegal for trans women to be regarded as women in public sector equality duties.
