Fact check: Is Germany's AfD not right-wing extremist?

The Federal Office for the Protection of the Constitution ( BfV ), a German-based domestic intelligence agency, has filed a lawsuit against the Alternative for Germany ( AfD ), which recently labeled the far-right party as” confirmed right-wing extremist.” The organization is now putting off its standard right-wing extremist party classification. Alice Weidel and Tino Chrupalla, the AfD officials, applauded the information as a victory. Claim:” This is a second essential step toward our conviction and toward defending the charge of right-wing extremism,” the group said on X. The BfV‘s designation as” confirmed right-wing radical” has been successfully “withdrawn,” according to the blog.

False DW reality search The term” confirmed right-wing radical” was not removed. In the most recent parliamentary election in February, the AfD applied to the court for an injunction if the BfV were to reject the” standstill” order. The AfD increased its number of seats to 152 ( out of 630 ). Both legal resources can be used by claimants to appoint an expert to halt actions they deem to be unconstitutional. The Federal Office has then preempted the release of such an order by issuing the” halt” order, which means that the Federal Office did not designate the AfD as a” verified right-wing radical” party until the trials have been concluded, according to Markus Ogorek, director of the Institute for Public Law and Administrative Theory at Cologne University. The Federal Office considers its categorization to be accurate, but it has only suspended the title to give the judge time to carry out a suitable review, according to Gorek, who agrees with him. He claimed that this would provide the competent judges enough time to finish the report’s over 1, 000 pages. The judge had had enjoined the BfV by refusing to postpone its decision. As Ogorek put it, this would have also frozen the earlier decision in order to stop the claimant from suffering” a potentially catastrophic disadvantage.” Who is the far-right AfD co-leader Alice Weidel in Germany? The Bundestag, Germany’s lower house of parliament’s research office, categorizes the AfD as a” proved right-wing radical” mostly as an “internal categorization by the regulators.” In some cases, the BfV may decide to set a lower threshold for knowledge surveillance methods than it did in the past as a” feared situation.” This might involve hiring secret agencies or making secret video and audio tapes. In both instances, however, the legal requirements are met. The AfD or the AfD’s legal representatives interpreting this” standstill” claim as if it were the first partial victory in the proceedings had been firmly refuted, Ogorek said.” This is common operational legal business.” This is essentially regular administrative procedural business. The BfV also made a pledge in this regard during a case in 2021 after the AfD filed a lawsuit against its classification as a” suspected case”. The court later issued a suspension order in that situation. The court cited as the “evidence that there was every reason to believe that the Office for the Protection of the Constitution had broken its promise to remain silent or had not taken sufficient precautions to ensure that no information related to the proceedings leaked out .” Prior to this, the German media had covered the proceedings extensively. The BfV was then allowed to monitor the AfD as a” suspected case,” according to a Münster Higher Administrative Court’s decision in an appeals court in 2024.
