    Judge orders Trump administration to help return deported Guatemalan man

    ‘Lacked any semblance of due process’: Judge orders Trump administration to help return deported Guatemalan man

    A federal judge’s order, which the Trump administration is using to facilitate the transfer of a Guatemalan guy who was deported to Mexico despite raising concerns about persecution that, was deemed to be in violation of the law’s “due process protections.” The person, who has been identified in court papers as OCG, is queer and had been protected from treatment to Guatemala as a result of a US immigration court’s decision. Immigration authorities rather sent him to Mexico, where he recently claimed to have been abducted and raped, before eventually returning to Guatemala. He is now hiding out. In his attempt issued late on Friday, US area judge Brian Murphy referred to the imprisonment as having “lacked any sort of expected approach,” as the news agency AP reported. The judge also criticized the government for its contradictory claims, first claiming OCG expressed no concern of Mexico and then after admitting it could not identify which established had received such a speech.” No one has ever suggested that OCG poses any sort of safety threat,” according to Murphy. Judge Murphy has then directed the government to look into how that information was collected, including how it was based on a program called the ENFORCE Alien Removal Module. The decision is one more in a long line of administrative rebukes against arrests made during the Trump era. In a related event, El Salvadoran man Kilmar Abrego Garcia was wrongly deported despite having spent 14 years living in Maryland. Although the administration claims it is unable to do so, citing state privacy and international incarceration, the Supreme Court granted his request. Judge Murphy noted that in the case of OCG, the person is not held by any foreign authorities, making his return much simpler. Murphy argued that “facilitating his return would not be expensive, costly, or restrict the government’s objectives.” Murphy also criticized a government document that incorrectly revealed the full title of OCG, increasing the risk for his health. Given the permanence of the internet, the judge rang a bell that apparently couldn’t be rung. OCG claimed in his declaracies to the court that he lives solely in his friend’s house in Guatemala, rarely ventures outside, and is” regular anxiety.” He said,” I can’t be gay here, which means I can’t be myself.” OCG is one of the many plaintiffs in a class-action petition challenging deportations that go against international law without having the opportunity to raise allegations of possible persecution. The group’s attorneys are also attempting to stop the imprisonment of eight different men to South Sudan, where things are still tense. According to reports, the Trump administration took them to a US defense base in Djibouti, where they are apparently being held. US Secretary of State Marco Rubio expressed concern about the US base’s use in Djibouti and warned that judge disturbance was pressure diplomatic relations with Libya and Djibouti. The plaintiffs have been labeled as “monsters” by the White House, and Judge Murphy, a Biden appointment, is a “far-left advocate determine.” Murphy, however, has remained consistent with judicial authority in upholding fundamental freedom and enforcing the right to converse with professionals. Their legal counsel had not yet been given access as of Friday night.
