Calling the Biden administration’s new decision to include gender identity in Title IX “election- time catering” and a threat to people — and the” reality” — Arkansas Gov. Sarah Huckabee Sanders issued an executive order instructing her state’s schools to ignore the instructions.
” The state’s educational institutions will continue to uphold state law that guarantees students ‘ privacy,” the statement read. The Republican governor’s executive order states that students should n’t be forced to take showers or undress with people of the other sex.
Huckabee Sanders is not alone.
Numerous Republican-led states are also challenging the new Title IX interpretation, and a number of conservative groups have sued  and Biden over its rewrite.
The Epoch Times reported on May 3 that” 15 states have filed lawsuits accusing the federal government of overreaching and changing the nature of the original law.” ” Governors and education chiefs in Texas, Oklahoma, Florida, Louisiana, Montana, and South Carolina have also told their school districts to ignore the new definition”.

Republican Texas governor instructs the Texas Education Agency to ignore your derogatory rule. In a memo to Biden on April 29, Greg Abbott wrote. By preventing men from competing against female athletes, you rewrite Title IX in ways that violate the laws that I signed to protect the integrity of women’s sports.
A lawsuit filed by Independent Women’s Forum, Parents Defending Education, Speech First, and several states last week also declares the rewrite illegal.
The unethical claim that sex is equivalent to gender identity is addressed in this lawsuit head-on. According to Paula Scanlan, former University of Pennsylvania swimmer and ambassador to the Independent Women’s Forum,” sex and gender are not the same, and eliminating sex from Title IX upends all protections for women in education, including the preservation of women ‘s-only sports and spaces.”
For Arkansas, it sees sex as an “immutable characteristic … rooted in biology”, the executive order states, adding biological males must not be placed in female- designated sports leagues, nor may schools and universities force the use of “false pronouns”.
The First Amendment guarantees the right to refuse to tell lies. This fundamental right will continue to be protected by my administration,” the order declares.
Many claim that Biden’s education department is unable to rewrite the 52-year-old federal law to include gender identity and sexual orientation. Huckabee stated in a press release announcing the order,” My message to Joe Biden and the federal government is that we will not comply.”

As The College Fix previously reported, while the Biden administration argued the rewrite does not make a final determination on transgender athletes, the 1, 577- page rule mentions “athletics” 31 times,” sports” 10 times and “team” 111 times. The rule takes effect Aug. 1.
According to the Epoch Times, the new Title IX interpretation also contravenes a number of state laws.
The “rule changes clash with laws in at least 11 conservative states that forbid gender-conflicted men from using female facilities. Laws requiring students to use the restroom corresponding to their sex are on the books in Alabama, Arkansas, Florida, Iowa, Kansas, Kentucky, North Dakota, Oklahoma, and Tennessee”, it reported.
